598 Deputy Michael Creed asked the Minister for Agriculture, Food and the Marine the position regarding an alleged overpayment in the 2010 disadvantaged area scheme to a person (details supplied) in County Cork; if in view of the small level of payment involved and the fact that the over claim is only marginally above the 3% threshold, he will review the level of penalty involved; and if he will make a statement on the matter. An application under the Single Payment Scheme was received from the person named on 12 May 2011, following processing of this application an overpayment was identified and notified to the person named. However, following an appeal by the person named, the matter was fully reviewed and it has been concluded that a penalty is not now warranted. The person named is being notified, in writing, of this decision. The refund due will issue shortly, directly to the nominated bank account of the person named.
