152 Deputy Thomas P. Broughan asked the Minister for Transport, Tourism and Sport when he intends to commence section 38 of the Road Traffic Act 2010, which will close the loophole whereby some drivers are getting their cases struck out by claiming they did not receive the notice to pay their fine in the post and therefore did not have a chance to pay the fine before being summoned to court; the reason there has been such a delay in commencing this section of the 2010 Act; and if he will make a statement on the matter. Further to my reply to Question No. 783 on 28 February 2012, Part 3, which includes section 38, of the Road Traffic Act 2010, which deals with changes to the fixed charge system, will be commenced when the necessary administrative and technical arrangements are in place to allow its effective implementation. My Department, the Courts Service and the Gardaí are progressing work in this regard in order to commence the relevant sections of the Road Traffic Act 2010 as soon as possible.
