484 Deputy Paul J. Connaughton asked the Minister for Justice and Equality the reason a person (details supplied) in County Galway is to be deported given that they are still married to an EU citizen; and if he will make a statement on the matter. [15303/12]

I wish to advise the Deputy that the person concerned was granted permission to remain in the State for a period of five years on the 11 June 2008 on the basis that he was the Spouse of an EU citizen who was residing in the State and in exercise of her EU Treaty Rights. However, the grounds under which he was granted permission to remain no longer apply as his EU citizen spouse, is no longer exercising her EU Treaty Rights in this State. Therefore, the residence permission which was granted under the provisions of the European Communities (Free Movement of Persons) Regulations 2006 and 2008 has now been revoked.

As the person concerned now has no immigration status in the State his file has been referred to the Repatriation Section for consideration of removal under Regulation 20 of the European Communities (Free Movement of Persons) Regulations 2006 and 2008.

Queries in relation to the status of individual immigration cases may be made directly to the INIS by e-mail using the Oireachtas Mail facility which has been specifically established for this purpose. This service enables up to date information on such cases to be obtained without the need to seek information by way of the Parliamentary Questions process. The Deputy may consider using the e-mail service except in cases where the response from the INIS is, in the Deputy's view, inadequate or too long awaited.
