348 Deputy Jack Wall asked the Minister for Social Protection the position regarding an appeal against the decision to refuse an application for carer’s allowance in respect of a person (details supplied) in County Kildare; and if she will make a statement on the matter. [29222/12]
View answerThe Social Welfare Appeals Office has advised me that an appeal by the person concerned was registered in that office on 10 January 2012. It is a statutory requirement of the appeals process that the relevant Departmental papers and comments by or on behalf of the Deciding Officer on the grounds of appeal be sought. These papers were received in the Social Welfare Appeals Office and the case was referred to an Appeals Officer on 21 May 2012 who will make a summary decision on the appeal based on the documentary evidence presented or, if required, hold an oral hearing. The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.
350 Deputy John O’Mahony asked the Minister for Social Protection when a person (details supplied) in County Mayo will receive a decision on their application for carer’s allowance; the reason for the delay in receiving a decision following the further information supplied by the person; and if she will make a statement on the matter. View answerI confirm that the department is in receipt of an application for carer's allowance from the person in question. The additional information has been forwarded to the medical assessor for further consideration. On completion of the necessary investigations relating to all aspects of the case a decision will be made and the person concerned will be notified directly of the outcome.
