This application was disallowed on 27 August 2012 on the grounds that the caree did not satisfy the medical criteria. A letter issued to the person in question on that day outlining the decision, the reasons for it and of his right of review or appeal.

The Social Welfare Appeals Office has advised me that an appeal by the person concerned was registered in that office on 29 February 2012. It is a statutory requirement of the appeals process that the relevant Departmental papers and comments by or on behalf of the Deciding Officer on the grounds of appeal be sought. These papers were received in the Social Welfare Appeals Office on 21 August 2012 and the case will be referred to an Appeals Officer who will make a summary decision on the appeal based on the documentary evidence presented or, if required, hold an oral hearing. The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.

I propose to take Questions Nos. 101 and 102 together.

The Social Welfare Appeals Office has advised me that the appeals by the person concerned were registered in that office on 23 May 2012 and 22 June 2012, respectively. It is a statutory requirement of the appeals process that the relevant Departmental papers and comments by or on behalf of the Deciding Officer on the grounds of appeal be sought. These papers were received in the Social Welfare Appeals Office on 27 June 2012 and 29 June 2012, respectively. The cases will be referred to an Appeals Officer who will make a summary decision on the appeals based on the documentary evidence presented or, if required, hold an oral hearing. The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.

This application for carer’s allowance was disallowed on 7th March 2012. It was refused on medical grounds. The person in question requested a review of this decision and submitted further medical evidence in support of the application. This information has been forwarded to the medical assessor for further consideration. On completion of this assessment, a deciding officer will make a full decision. The application will be processed as quickly as possible and when a decision is made the person concerned will be notified directly of the outcome.
