Water and Sewerage Schemes Status

Deputy Dessie Ellis asked the Minister for the Environment; Community and Local Government if his attention has been drawn to the findings of the steering group formed by Longford County Council and the Health Service Executive to investigate issues related to deficient private sewerage networks and sewerage gas ventilation systems in an area (details supplied) in County Longford; the explosions they investigated which happened on 15 march 2012; the recommendations made by this steering group into keeping the site safe for persons who live there and the assistance he plans to give the local authorities and the persons living on the estate to rectify the problems which are a threat to health. I propose to take Questions Nos. 375 to 377, inclusive, together.

Under the Public Safety Initiative for Unfinished Housing Developments my Department has made allocations totalling some €3.338 million to 21 local authorities from the funding made available to address immediate public safety issues. The types of works that have been approved to date include the fencing off of unsecured and hazardous areas, capping of pipes, installation of street lighting and other works to secure sites. In respect of the development of Gleann Riada, Longford, my Department approved funding totalling €91,753.40 in August 2012 to cover the cost of addressing immediate public safety concerns.

Issues pertaining to individual planning applications are matters for the local authority concerned, and my Department has no remit in this regard. However, I have been advised that, subsequent to the events of March 2012, Longford County Council appointed Tobin Consultants to investigate the causes of the explosion. The findings of this report were given to the occupants of the six properties involved. Longford County Council has also established a steering group to address the range of issues faced by the occupants of the Gleann Riada development. As this matter is currently the subject of legal proceedings, it would be inappropriate to comment further at this time.

Social and Affordable Housing Provision

Deputy Catherine Murphy asked the Minister for the Environment; Community and Local Government if the social housing element of part V of the Planning and Development Act 2000 is still in place; the number of houses that have come into the housing stock from that source by county since 2011; and if he will make a statement on the matter. The Government announced the standing down of all affordable housing schemes – including affordable housing delivered under Part V – in the housing policy statement published in July 2011. This did not affect Part V agreements for the delivery of social or affordable housing already entered into nor has the law relating to the operation of Part V changed since that time. However, the policy statement did indicate that a review of Part V of the Planning and Development Acts would be undertaken . That review is currently on-going and I expect the report to be delivered to me later this year. Any future changes to legislation governing Part V will be informed by that review. The social housing element of Part V of the Planning and Development Act 2000 has yielded 297 units in 2011 with 165 units in progress and 592 units proposed. The breakdown is available on my Department’s website at www.environ.ie

I established a Local Government Committee in September 2011 to carry out a review of local government arrangements in Waterford and to submit a report containing recommendations on whether the County Council and City Council of Waterford should be unified. The report of the Committee has been submitted to my Department and its recommendations will form an important component of the policy statement and action programme for the reform of local government that I intend to publish shortly. Subject to decisions by Government on structures at county and sub-county level, the policy and action programme will give rise to a review of local electoral areas and councillor numbers which will be a matter for examination by an independent local electoral boundary committee in due course.

As of 2 October, applications in respect of the on-site wastewater treatment systems of some 165,253 owners, who have registered on-line, by post or in person at their local authority offices, have been processed. I understand that a further 85,000 owners have submitted registration applications which are yet to be processed by the bureau operated by the Local Government Management Agency. Householders who have not yet registered have until 1 February 2013 to register their system. Census 2011 recorded that there are 497,281 households served by septic tanks or other treatment systems. Details of the numbers of processed registrations for each County and City Council are set out in the following table.

As of 30 June 2012 there were 235.65 (whole time equivalent) local authority staff on salary scales the maximum points of which are in excess of €100,000. The grades concerned are City and County Managers, Assistant Managers and Directors of Service. The number of Directors of Service has reduced from 262 (WTE) in 2008 to 203 (WTE) (-23%) at present. A workforce study has been undertaken jointly by local authorities and my Department. In particular, it assesses the management requirements of local authorities bearing in mind the potential impacts of shared services and other reform initiatives. Each local authority will in turn prepare a detailed workforce plan outlining how it will implement the Study’s recommendations.

My Department spent some €323,000 on consultancy in 2011 and the estimated expenditure for this purpose in 2012, as set out in Appendix 7 of Revised Estimates for Public Services 2012 published by the Department of Public Expenditure and Reform, is €357,000.

The cost of foreign travel undertaken by the staff of my Department in 2011 was €415,027. In addition, expenditure on Foreign Delegates Allowance in 2011 was €73,487. Foreign travel costs to date in 2012 are €503,730 from a budget of €636,000 for the full year. Foreign Delegates Allowance cost €84,014 to date in 2012; however expenditure under this allowance will cease, as it has been abolished under the Department of Public Expenditure and Reform Review of Allowances in the Public Sector. 2012 expenditure includes additional foreign travel undertaken at both at EU and international level arising from increased activity and workload in the lead up to Ireland’s Presidency of the EU which commences on 1 January, 2013. Delivering effectively on our Presidency responsibilities will involve a significant increase in foreign travel during this period.

The majority of foreign travel undertaken by my Department involves attending European Union related meetings, usually in Brussels. Other foreign travel, including that in relation to United Nations commitments, is undertaken as necessary to attend meetings in Geneva, Bonn, Paris, New York, Nairobi and elsewhere on matters that are under the remit of my Department. At all times my Department seeks to minimise the costs of such travel and will also recoup an element of this expenditure, where possible, from the EU in due course.

Further details of foreign travel costs are not readily available and, given the extent of international business conducted by my Department, would require a disproportionate amount of staff time and resources to compile.

My Department’s National Directorate for Fire and Emergency Management is currently processing the output from a round of stakeholder consultation on the draft “Keeping Communities Safe” (KCS) document. The draft document is currently being revised on foot of the submissions received with the intention of publishing the final KCS document before the end of the year. It is intended that the national norms and standards set in KCS together with the application of a national model for a Risk Based Approach, will be integrated into future service planning within each local authority’s fire service.

The EPA is responsible for developing a National Inspection Plan upon which the risk-based inspection of domestic wastewater treatment systems will be based. The Plan will be in accordance with the EU’s Recommendation for minimum Criteria for Environmental Inspections document (Reference 2001/331/EC) which makes recommendations for the consistent implementation and enforcement of Community environmental law in all EU Member States and is the appropriate framework for the carrying out of environmental inspections. The EPA will publish the final Plan later this year and inspections will commence next year. The Water Services (Amendment) Act 2012 was required to ensure compliance with the 2009 ruling of the European Court of Justice. My Department continues to liaise with the European Commission regarding implementation of the legislation. The correspondence between my Department and the Commission on the matter is exempt from release under Section 24 of the Freedom of Information Acts 1997 and 2003.
