Deputy Eoghan Murphy asked the Minister for Justice and Equality further to Parliamentary Question No. 127 of 27 September 2012, if he is in a position to instruct public bodies to waive their upward only rent review clause on legacy commercial leases for tenants when there is no borrowing against the asset in question; and if he will make a statement on the matter. I have no function in relation to the matter raised. By way of general comment, the nature and application of a commercial lease is a matter for the parties to that lease, and that position applies irrespective of whether or not a public body is one of the parties to such a lease.
