View answerThe Programme for Government includes a commitment to introduce a Mental Capacity Bill. The Bill will provide for the repeal of the Lunacy Regulation (Ireland) Act 1871 and the replacement of the Wards of Court system provided under that Act with a modern statutory framework to support persons with impaired decision-making ability. My intention is to ensure that the Bill is in line with the UN Convention on the Rights of Persons with Disabilities. The proposals in the Scheme of the Bill, as published, have required extensive revision in order to meet that objective. Drafting of the Bill is at a very advanced stage and I expected it to be published early in the New Year.
