Deputy Brendan Ryan asked the Minister for the Environment, Community and Local Government if he will clarify the person liable if a member of the general public that is a person not the owner of the house and not present in the house were injured in an accident caused by pyritic heave in a house for instance, a shattering window pane or gas explosion; and if he will make a statement on the matter. My Department has no function in regard to the matter outlined in the question. The issue of liability in particular circumstances would be a matter for determination by the parties themselves and/or their legal representatives.
