I propose to take Questions Nos. 709, 711, 712, 726, 729, 732 and 733 together.

The introduction of pay parking at Howth Fishery Harbour Centre is currently under consideration. The Rates and Charges Order of 2012 is the legal instrument that provides for parking charges in the Fishery Harbour Centres, and that order provides for maximum charges. The specific elements of any possible scheme that might be introduced are currently being worked on and I will be deciding in due course on the matter, including the detail of how any scheme would apply, and the amount of charges for parking.

In order to improve traffic management, enabling works and upgrading works to the car parks within the Fishery Harbour, including lining of parking spaces, have been taking place over a number of months.

Howth Fishery Harbour Centre is first and foremost a working fishery harbour. It has a number of business customers, including business tenants, vessel owners and crew, etc and, full access is required for commercial traffic servicing the fishing side and the various ancillary enterprises, with appropriate parking arrangements. It is acknowledged that there are, and have always been, a wide range of recreational users of Howth Fishery Harbour Centre also, including the yacht club, walkers, sightseers and other social users. A significant number of parking spaces in Howth Fishery Harbour are currently being taken up by commuters using the DART service during the working week.

Traffic and parking management within the Fishery Harbour Centre itself has been an issue for some time, particularly in the light of concerns raised about safety and emergency access by the Coastguard, the Lifeboat service, and an Garda Síochána. The introduction of pay parking is one (and only one) of a number of measures being introduced to address those concerns.

The introduction of parking charges at Howth Fishery Harbour Centre was originally examined in great detail in 2007 in the context of a proposed Howth Traffic and Parking Management Plan, in conjunction with Fingal County Council. There was widespread public consultation at that time but that project did not subsequently proceed. The outcomes of that public consultation as well as more recent correspondence from a wide range of harbour users, contact between my officials and harbour business tenants and general concerns about the possible effect that the introduction of pay parking might have will be taken into account in arriving at a final pay parking scheme at Howth Fishery Harbour Centre.

Fishery Harbour Centres are financed from the Fishery Harbour Centres Fund. All income generated in the Fishery Harbours is lodged to this ring-fenced Fund, and it is the only funding available for the operation and management of the Fishery Harbours, of which Howth is one of 6 in the State.

Any additional revenue that is generated from pay parking at Howth Fishery Harbour Centre will be re-invested in facilities and enhancements that would not otherwise have been possible given the current financial constraints. This will, if anything, help to attract inward investments into the Fishery Harbour Centres, and ultimately provide more employment opportunities, not less.

Fingal Council has also been consulted about the current plans and in relation to issues of traffic management at both formal and informal meetings with my officials over the past year.

There are approx 500 parking spaces in the Fishery Harbour Centre at present. These spaces, although only recently lined and marked, have been in place for a considerable number of years and so it is not considered that a formal planning application should be required. However, in November 2012, my Department wrote to Fingal Council in order to establish whether or not planning permission is required for the installation of pay and display machines, and a reply is awaited.

I can assure the deputies that the new parking arrangements will be designed as far as possible to be fair to all users, while ensuring that everyone pays their fair share of the cost of upkeep of the facility.

Pay parking was introduced into the Fishery Harbour Centre in Ros an Mhíl in June 2012, pay parking has been in operation at Dingle since before it was designated as a Fishery Harbour Centre in 2007 and there are currently no plans to introduce pay parking at the other fishery Harbour Centres (Castletownbere, Killybegs, and Dunmore East).

Departmental Funding

Deputy Damien English asked the Minister for Agriculture, Food and the Marine if he will provide details of all funding programmes in his Department that community, voluntary and sporting organisations may apply to for funding; if he will provide a brief overview of each programme; the opening and closing dates of each programme; the minimum and maximum amounts of funding that may be applied for; and if he will make a statement on the matter. Since 1995, my Department has made ex-gratia payments to a number of organisations directly involved in the delivery of animal care and welfare services. In 2012 it supported 140 organisations throughout every county in the country to the tune of €1.365 million. The funding available to individual organisations is intended only as a contribution to the overall costs of an organisation. In recent years my Department has urged those organisations that have the capacity to deal with larger animals to consider placing greater resources in assisting with promoting horse welfare.

Additionally, coastal community or voluntary groups may potentially be eligible for funding under the Seafood Development OP 2007-2013. Axis 4 of the Programme aids the sustainable development of fisheries areas. This is being implemented around the Irish coast by Fishery Local Action Groups (FLAG’s) who develop and implement strategies in their local areas. If any organisation submits a proposal that is coherent with the objectives of the local strategy, then funds may be allocated.

The opening dates for funding under Axis 4 will be the date that local strategies are in place for each FLAG, which are scheduled to be approved by various FLAGs throughout 2013. The closing date for the programme will be June 30th 2015. FLAGs may invite applications for funding from time to time, subject to annual budgetary allocations from BIM. FLAGs may limit the amount of funding allocated to individual projects.

Aquaculture Licences Applications

My Department is responsible for licensing the cultivation of aquatic plants such as seaweed under the provisions of the Fisheries (Amendment) Act 1997. My Department is also responsible for licensing the harvesting of seaweed to be used wholly or primarily for fishing or aquaculture related purposes under the provisions of the Foreshore Act 1933.

Applications are assessed by reference to scientific, technical and environmental considerations which will vary depending on the circumstances of each application.

Licensing in relation to the harvesting of seaweed for all other purposes is a matter for the Minister for the Environment, Community and Local Government.

I wish to advise that the Government decision on Coillte was that a concession for the harvesting rights to Coillte’s forests be considered for sale. While the consideration process is at an advanced stage, no decision has been taken, as yet.

I also wish to remind the Deputy of the use to which the proceeds of such asset sales may be put as provided for under the EU/IMF Programme. As agreed with the Troika, half of the proceeds will be available to the Government to fund employment enhancing projects of a commercial nature, with the other half, while destined eventually to pay-down debt, also being available in the first instance to constitute a fund to underpin additional lending into Ireland.

Control of Dogs

The Control of Dogs Acts, 1986 and 1992 place statutory responsibility for dog control on local authorities. With regard to sale of dogs, the Animal Health and Welfare Bill includes provisions relating to the regulation of welfare of animals during sale and sale of animals to minors. In particular, Section 22 of the Bill proposes to make it an offence for a person to sell an animal to a person who is apparently under the age of 16 years.

Additionally, as part of the allocation of funding made by me to animal welfare organisations, recipients are reminded of the importance of neutering programmes for dogs and that all animals being re-homed should be neutered unless veterinary opinion advises otherwise.

I have announced my intention to appoint Mr. Joe Keeling to succeed Mr. Denis Brosnan as Chairman of Horse Racing Ireland in the near future.

Veterinary Inspection Service Remit

Under EU law primary responsibility for the safety of food placed on the market place lies with food business operators. The role of my Department is to verify compliance by the food business operators with this requirement. This is done by a combination of inspection of establishments and by audit on the food safety management systems which operators are required to have in place. These controls are applied at different stages in the food supply chain. It is important to point out that the key controls carried out by my Department, under its contract with the FSAI, relate to food safety.

My Department has a permanent veterinary presence at all its approved slaughter plants. Controls at stand alone secondary processing plants are carried out at a frequency which is based on an annual risk assessment for each plant.

An annual audit of imported products is carried out in each Department approved meat plant. The audit includes physical identity, labelling and documentary checks. This includes product originating both in EU Member States and third countries. In addition, labelling and documentary checks form part of the routine checks conducted by Department officials.

Under the Department’s National Residue Programme, and including tests on bovine samples carried out by processors, some 30,000 samples taken at farm and factory level and covering a wide range of food stuffs are tested annually. These tests relate to microbiological and chemical standards, their primary focus being on food safety. These are fully in accordance with EU testing requirements.

In addition the Product Official Sampling and Testing (POST) programme is a microbiological testing programme on samples taken from Department approved ready-to-eat food, meat product, minced meat and meat preparation plants i.e. added value plants. This is part of the official verification of food safety controls in the plants concerned as provided for in Regulations (EC) 852/2004, 854/2004 and 2073/2005. A total of 1,600 samples are taken annually and the sampling and testing is risk based.

DNA testing is not required under EU legislation and is not generally in use in relation to food production. It has however been deployed in recent times as part of the FSAI’s checks on food authenticity and food fraud control programmes. In that respect it is another new layer to our food production controls.

Single Payment Scheme Eligibility

The Regulations governing the Single Payment Scheme provide that entitlements have to be used at least once in every two-year period. "Used" in this context means that in any of two consecutive years one hectare of eligible land must have been declared in respect of each entitlement held. The Regulations further provide that any entitlements that remained unused over the two-year period must revert to the National Reserve and are thereby lost to the farmer.

A letter issued to the person named on 9 January 2013 advising that 5.87 Entitlements had remained unused in the two – year period, 2011 and 2012. The person named was advised that before a final decision was made in the matter the Department would consider any observations he may wish to make. To date no letter of appeal has been received. If the person concerned wishes to set out any mitigating factors as to why the entitlements in question were not used in the period concerned he should make contact with my Department.
