133. Deputy Stephen S. Donnelly asked the Minister for the Environment, Community and Local Government if residents are entitled to apply for a core facility wastewater treatment plant to be fully taken in charge, should the majority of householders in the area support an application to do so, as laid out in the 2008 circular letter PD 1/08 on guidelines for implementation of section 180 of the Planning and Development Act 2000; and if he will make a statement on the matter. Section 180 of the Planning and Development Act 2000 places a legal obligation on planning authorities to take in charge residential developments, finished or unfinished, where certain conditions have been met. My Department’s Circular Letter PD 1/08 required planning authorities to develop or update their policy on taking in charge, as approved by the members of the authority, on the basis of the framework set out in the Circular and its annex. This framework identifies wastewater treatment plants as among the facilities to be considered for taking in charge.
