Deputy Kevin Humphreys asked the Minister for Agriculture, Food and the Marine if he will provide a list of the Acts or specific provisions of Acts under his Department that have not yet been commenced; if it is intended to commence the provision in each case; if so, when; and if he will make a statement on the matter. The recently passed Animal Health and Welfare Act, 2013 will be commenced shortly in conjunction with a package of secondary legislation necessary for the Act to have full effect. Section 98 of the Sea-Fisheries and Maritime Jurisdiction 2006 Act has not been commenced. At this point in time there are no plans to commence this provision. Section 5 of the FISHERIES (AMENDMENT) ACT 2003 (which is part of the 2006 Act) has not commenced with respect to an application for an authorisation or permit. At this point in time there are no plans to commence this part of the provision.
