174. Deputy Róisín Shortall asked the Minister for Social Protection if she will provide an update on the invalidity pension application in respect of a person (details supplied) in Dublin 11; when the claim will be decided; if her Department is considering a disability allowance application for this person; and if so the outcome of this application. I am advised by the Social Welfare Appeals Office that an Appeals Officer, having fully considered all of the available evidence, has decided to allow the invalidity pension appeal of the person concerned by way of a summary decision. The person concerned has been notified of the Appeals Officer’s decision.

With regard to the disablement pension appeal, I am further advised by the Social Welfare Appeals Office that the case was referred to same Appeals Officer who has requested clarification on certain issues from the Department. On receipt of their response, the Appeals Officer will make a summary decision on the appeal based on the documentary evidence presented or, if required, hold an oral hearing.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions in relation to social welfare entitlements.
