629. Deputy Michael Moynihan asked the Minister for Agriculture, Food and the Marine the reason a person (details supplied) in County Kerry received a penalty on a single farm payment; and if he will make a statement on the matter. [55324/13]

An application under the Single Payment/Disadvantaged Areas Schemes was received from the person named on 15 May 2013. This application was one of those selected for Satellite (remote sensing) Inspection. Following initial processing of which, an over claim was determined. A subsequent ground examination confirmed the over claim. The total area over claim was between 3% and 20%, with resultant penalty applied to the application of the person named as per the Terms and Conditions and the relevant EU regulations. Based on the reduced area, advance payment issued on 16 October with the balance issuing on 2 December. A letter explaining the foregoing and also informing the person named of a right to appeal, issued on 27 September 2013.
