Deputy Martin Ferris asked the Minister for the Environment, Community and Local Government if his attention has been drawn to the implications for farmers in relation to succession rights of the Memoranda of Understanding being signed by those who have allowed their land to be used by wind turbine operators. 512. Deputy Martin Ferris asked the Minister for the Environment, Community and Local Government if his attention has been drawn to the concerns that landowners who have entered into option agreements with developers of wind farms have unwittingly been tied into legally binding contracts that stop succession rights to the land, prevent activity on the property which may interfere with the wind speed or wind direction over the property, that landowners will not apply for any planning permission without first requesting the developer's approval; and if he will make a statement on the matter. I propose to take Question Nos. 511 and 512 together.

I have no role in relation to private legal contracts entered into between land owners and developers of wind farms. It is a matter for land owners to seek their own legal advice on such matters.
