Mental Health Services Provision

201. Deputy Colm Keaveney asked the Minister for Health the policy initiatives that his Department has taken since 2011 aimed at lessening the influence of the pharmacological industry in the delivery of mental health care; and if he will make a statement on the matter. [30511/14]

A Vision for Change, our mental health policy, proposes a holistic view of mental illness and recommends an integrated multidisciplinary approach to addressing the biological, psychological and social factors that contribute to mental health problems. A number of initiatives have been put in place in recent years to underpin this approach and lessen the influence of traditional models of care.

A Vision for Change recommends that service users and carers should participate at all levels of the mental health system. It is acknowledged that service users have a unique insight into the experience of mental illness and are central to how we progress and further develop our mental health services. In January 2014, the HSE appointed an interim Head of Service User, Family Member and Carer Engagement as a member of the HSE National Mental Health Management Team and also committed to the establishment of a Reference Group to provide service user, family member and carer input into new organisational structures.

It is accepted that a recovery orientation should inform every aspect of service delivery and that service users should be partners in their own care. The Recovery approach that we want to see places a unique emphasis on the value of each person and their understanding of their illness and should be seen as natural process which service users believe can put greater choice and control back in their hands.

The 'Advancing Recovery in Ireland' (ARI) initiative is a partnership project between the HSE and other bodies which recognises the service provider, service user and family as equal stakeholders. The initiative focuses on service level structures, systems and practices that can maximise personal recovery opportunities and outcomes for service users. Some of the innovations being developed through ARI are Recovery Colleges, Peer Support Working and the Recovery Context inventory Tool. The ARI is an 18 month initiative which is being rolled out on a phased basis to allow maximum benefit, the initial phase of which commenced in May 2013.

This Government has, since 2012, provided additional funding totalling €90 million and some 1,100 posts primarily to strengthen and enhance Community Mental Health Teams to ensure multidisciplinary representation on these teams, including social workers, occupational therapists, psychologists etc. The Counselling in Primary Care Service (CIPC), which was launched in July 2013, is a new national service which will improve access for people to counselling in a primary care setting. At full capacity, CIPC will be able to deliver short term counselling to approx. 13,000 people over a full year. Medical card holders aged 18 and over who are referred by their GP or other member of the primary care team can have up to 8 counselling sessions to address mild to moderate psychological difficulties.

All psychiatrists prescribe medication following evidence based practice on the treatment of specific mental illnesses. All psychiatrists are required by the Medical Council to complete a programme of ongoing professional education to ensure they maintain up to date in all relevant aspects in their area of clinical specialism. This is overseen by the Irish College of Psychiatrists on behalf of the Medical Council. The Mental Health Commission requires each inpatient mental health unit to have a policy on the prescribing, dispensing and storage of medication based on its standards. During its annual inspection of each inpatient unit, the Inspector of Mental Health Services examines each unit's policy and reports on its compliance.

Hospital Trusts

Ahead of the establishment of Independent Hospital Trusts on a statutory footing, seven non-statutory Hospital Groups have been established. These are the Dublin East Hospital Group, Dublin Midlands Hospital Group, Dublin North East Hospital Group, West/North West Hospital Group, South/South West Hospital Group, University of Limerick Hospital Group and the Children's Hospital Group. Details of the hospitals in each group are set out below.

It is a priority for the Health Service Executive to have CEOs and management teams in place in all Hospital Groups as soon as possible in order to progress the extensive reform programme for Hospital Groups. The HSE has advised that Group CEOs are currently in place for three hospital groups. These are Mr Bill Maher, who was appointed to the West/North West Hospital Group on the 9th January 2012, Ms Ann Doherty, who was appointed to the UL Hospital Group on the 9th January 2012, and Ms Eilish Hardiman who was appointed to the Children's Hospital Group on the 1st November 2013. Mr Gerry O'Dwyer was appointed as CEO to the South/South West Hospital Group on an interim basis on the 3rd March 2014. Interim arrangements are in place in relation to operational responsibility for Dublin East, Dublin Midlands and Dublin North-East Hospital Groups pending the recruitment of CEOs for these Groups.

Phase II of the Health Reform Programme provides for the dissolution and replacement of the Health Service Executive with the introduction of a formal purchaser/provider split, the establishment of a Healthcare Commissioning Agency and a range of provider agencies. These include Hospital Trusts and a community care structure to deliver Primary and Social Care.

My Department is currently working on a policy paper setting out a coherent legal and governance framework for the implementation of Phase II of the Reform Programme. In parallel it is also developing legislative proposals for the implementation of this Phase of the Programme.

Medical Card Applications

The Health Service Executive has been asked to examine this matter and to reply to the Deputy as soon as possible. The Health Service Executive operates the General Medical Services scheme, which includes medical cards and GP visit cards, under the Health Act 1970, as amended. It has established a dedicated contact service for members of the Oireachtas specifically for queries relating to medical cards and GP visit cards, which the Deputy may wish to use for an earlier response. Contact information has issued to Oireachtas members.

Mental Health Services Provision

Deputy Anthony Lawlor asked the Minister for Health the position regarding the provision of mental health services in accident and emergency departments throughout the country; his plans to increase the level of funding for mental health care in accident and emergency departments nationally; and if he will make a statement on the matter. Where an individual is in distress, their fist point of contact is the GP who can assess their situation and decide if referral to a specialist service is required. In the event of an emergency, an individual may present to a hospital emergency department where he/she will be assessed and may, if it is deemed clinically appropriate, be referred to the mental health service or may be admitted to an acute psychiatric unit.

Since 2012, this Government has prioritised the reform of our mental health services with the provision of an additional €90 million and some 1,100 new posts for mental health, including 37 new Clinical Nurse Specialist posts for hospital emergency departments as part of the Clinical Care Programme for responding to self harm presentations. The question of funding for mental health next year will be considered as part of the Estimates Process 2015.

Public Sector Staff Retirements

Deputy Robert Troy asked the Minister for Health in view of the 2007 case, details supplied, in which the European Court of Justice held that compulsory retirement clauses set by law were discriminatory on grounds of age and could only be objectively justified in certain circumstances, and the High Court approving the decision, if he will review Health Service Executive contracts which have a retirement age of 65 for persons who may wish to work longer; and if he will make a statement on the matter. In the Judgement referred to by the Deputy, it was held that the Minister was obliged to justify compulsory retirement at age 65. The Court went on to outline that such a measure could be justified by reference to the following: (a) That the measure is a genuine and determining occupational requirement; (b) That the measure is aimed at preserving operational capacity; (c) That the measure is justified by a legitimate aim - in the case in question this was employment policy; (d) That the measure is justified by a legitimate aim, and that the means of achieving that aim are appropriate and necessary.

In light of the current legislative position, I do not consider that the review sought by the Deputy is warranted.

Medicinal Products Availability

The Health Service Executive (HSE) has statutory responsibility for decisions on pricing and reimbursement of medicinal products under the community drug schemes in accordance with the provisions of the Health (Pricing and Supply of Medical Goods) Act 2013.

The HSE received an application for the inclusion of fampridine (Fampyra®) in the GMS and community drugs schemes. The application was considered in line with the procedures and timescales agreed by the Department of Health and the HSE with the Irish Pharmaceutical Healthcare Association (IPHA) for the assessment of new medicines. In accordance with these procedures, the National Centre for Pharmacoeconomics (NCPE) conducted a pharmacoeconomic evaluation of fampridine and concluded that, as the manufacturer was unable to demonstrate the cost effectiveness of fampridine in the Irish healthcare setting, it was unable to recommend the reimbursement of the product. The report is available on the NCPE's website, www.ncpe.ie. The NCPE report is an important input to assist the HSE in its decision making process and informs further discussions between the HSE and the manufacturer of the drug. The HSE assessment process is intended to arrive at a decision on the funding of new medicines that is clinically appropriate, fair, consistent and sustainable. In these circumstances, the HSE has not approved the reimbursement of Fampridine under the GMS or other community drug schemes. However, I am aware that studies are ongoing to assess the wider impact of fampridine on both walking and quality of life for persons diagnosed with MS. The results of these studies will contribute to the evidence base demonstrating the clinical effectiveness of the product which can be used to support future applications for its inclusion on the lists of reimbursable items supplied under the GMS and other community drugs scheme.

The HSE met with Biogen Idec recently to discuss a potential revised application. The HSE expects that Biogen Idec will submit a revised application. The HSE will then re-consider the application in as timely a fashion as possible in line with the agreed procedures and timescales for the assessment of new medicines.

The action plan submitted by Cavan & Monaghan Hospital relates to the achievements and maintenance of scheduled care wait time targets for patients availing of outpatients appointments. This plan was submitted to the National Director of Acute Hospitals in Quarter 1 2014. It is currently under review by the National Director.

At local level Cavan & Monaghan Hospital are doing all possible to facilitate outpatient appointments within the target timeframes for patients.

Orthodontic Service Waiting Lists

The HSE provides orthodontic treatment to patients based on their level of clinical need. An individual's access to orthodontic treatment is determined against a set of clinical guidelines and priority is given to patients with greatest needs. The HSE has been asked to examine the specific query raised by the Deputy and to reply to him as soon as possible.

Since the Health Information and Quality Authority was established by the Health Act 2007, it has carried out a large number of inspections of designated centres for older people, children's residential centres, special care units and foster care settings and hospitals. In November 2013 HIQA took on responsibility for the regulation of residential and residential respite services for children and adults with disabilities provided by the Health Service Executive (HSE), private organisations or voluntary bodies.

HIQA publishes the results of all its inspections which includes recommendations on any improvements necessary to meet the requirements of the regulations and standards which are in place. The Department or HIQA does not keep a record of the cost of remedial works undertaken or service improvements introduced by public and private service providers in order to comply with these regulations and standards.

The HSE provides orthodontic treatment to patients based on their level of clinical need. An individual's access to orthodontic treatment is determined against a set of clinical guidelines and priority is given to patients with greatest needs. The HSE has been asked to examine the specific query raised by the Deputy and to reply to him as soon as possible.

The scheduling of appointments for patients is a matter for the hospital to which the patient has been referred. Should a patient's general practitioner consider that the patient's condition warrants an earlier appointment, he or she would be in the best position to take the matter up with the consultant and hospital involved.

In relation to the specific case raised by the Deputy, as this is a service matter it has been referred to the HSE for direct reply.
