I have been advised by the Revenue Commissioners that a tax credit certificate for 2014 issued to the person concerned on 7 March 2014.  The certificate was issued based on the information available to Revenue at that time and included the personal tax credit of €1,650 and the PAYE tax credit of €1,650.

The Revenue Commissioners have now written to the person concerned for additional details to bring his tax affairs up to date.  His tax credits will be adjusted, as necessary, on receipt of a full reply.

The most recent data in relation to the general government balance figures for the periods 2010-2014 and 2013-2018 are available in the 'March 2014 EDP' publication (available on the CSO and Eurostat websites) and the April 2014 'Stability Programme Update' publication respectively. As per the deputy's query the headline and underlying balance figures (under an ESA 95 basis) in relation to the years 2010-2013 are as follows:

A full breakdown of government finance statistics under ESA 2010 will be published by the CSO in July 2014 as part of their quarterly release of this data.

I propose to take Questions Nos. 60 to 65, inclusive, together.

I wish to advise the Deputy that my Department's policy in relation to the provision of Assistive Technology support for pupils with Special Educational Needs is set out in Department of Education and Skills Circular 0010/2013. The National Council for Special Education (NCSE), through its network of local Special Educational Needs Organisers (SENOs), is responsible for processing applications from schools for special educational needs supports. SENOs also make recommendations to my Department where Assistive Technology is required. In order to qualify for equipment under the Assistive Technology scheme, a child must have been diagnosed with a physical or communicative disability and must also have a recommendation in a professional assessment that the equipment is essential in order to allow the child to access the curriculum. It must also be clear that the existing I.T. equipment in the school is insufficient to meet the child's needs. As part of the application process, for which parental consent is required, schools set out how and in what manner the equipment which has been recommended in the professional report will be used in the classroom. Although equipment is sanctioned to support a particular pupil, the equipment is sanctioned to a school and will, as a general rule, remain the property of the schools and be available for allocation to other or subsequent pupils with similar disabilities. Circular 0010/2013 explains that the pupil in question may, with the consent of the management authority, use the equipment at home. The Circular also sets out the position regarding the transfer of equipment when pupils change school. Should a parent be dissatisfied with the manner in which the resources or facilities which have been provided to support their child's education are being applied in school, they should raise this matter directly with their school Principal or the Board of Management of the school. I wish to explain also that my Department provides a range of supports for teachers in the area of Assistive Technology which are set out in Circular 0010/2013 also. These include support through the Special Education Support Service (SESS) which provides seminars and courses as well as support available through the SESS Support Scheme in the area of Assistive Technology, details of which are available at http://www.sess.ie. Finally, I wish to advise the Deputy that the NCSE recently published comprehensive policy advice on Supporting Students with Special Educational Needs in Schools, which is available on its website www.ncse.ie. This advice recommended that the NCSE should establish a working group, with Assistive Technology expertise, to develop a national policy on standards for professional recommendations and to determine the supports required in an educational context and the best ongoing utilisation of these resources. The future of the Assistive Technology scheme will therefore be considered in the context of the implementation of this recommendation. The NCSE has commissioned research on the use of assistive technology/equipment in supporting the education of children with special needs in schools. The outcome of this research will support the considerations of an Advisory Group which has been established, in relation to the future of the Assistive Technology scheme.

It is a legal requirement of all educational providers that they ensure there is equality of opportunity for all learners in accordance with relevant legislation. The Equal Status Acts 2000-2008 require educational institutions/service providers, including private providers, to do all that is reasonable to accommodate the needs of a person with a disability. All providers, public and private, of Springboard courses have been reminded of their obligations to ensure that appropriate facilities are in place to support the participation of people with disabilities. 17 private or not for profit providers of higher education will receive funding under Springboard 2014.

The Department does not have information on disability support services within private sector institutions.

The Deputy will be aware that under the terms of my Department's Primary School Transport Scheme, children are eligible for transport where they reside not less than 3.2 kms from and are attending their nearest national school as determined by my Department/Bus Éireann, having regard to ethos and language. These eligibility criteria are applied equitably on a national basis to all children attending a national school.

Re-engagement, or the formal agreement of quality assurance (QA) procedures with QQI, is a requirement for legacy providers, such as the organisation referred to by the Deputy, under the Qualifications and Quality Assurance (Education and Training) Act, 2012. It will happen only once for a provider; thereafter the provider will have to undergo periodic review of the effectiveness of its QA procedures. The re-engagement process will allow providers to demonstrate their capacity in respect of the development, ownership and implementation of their QA procedures, including the development of programmes and assessment of learners. The fees to be applied to legacy providers seeking to re-engage with QQI have yet to be determined. QQI's proposals in that regard, and any associated issues, will be considered when they are made.

With regard to school properties over which a charging lease was in place and where a request to release the Minister's interest was received, details in relation to such properties are held on individual files. Therefore the scope of the Deputy's request is such that the information requested is not readily available. To identify, retrieve and examine individual files would involve significant manual processes to the extent that it would cause a substantial and unreasonable disruption of the work of the Department. However, where information is available in electronic format such that it can be collated, the details will be compiled and forwarded to the Deputy.

The Deputy will appreciate that in the absence of all of the relevant details that would be contained in an individual's application form and supporting documentation, it would not be possible for me to say whether or not a student would qualify for a grant.

In relation to support available for students studying abroad, my Department's Student Grant Scheme provides maintenance grants to eligible undergraduate students pursuing approved courses in other E.U. Member States. In general, an approved undergraduate course in this context is defined as a full-time undergraduate course of not less than two years duration pursued in a university or third level institution, which is maintained or assisted by recurrent grants from public funds in another EU Member State. The Student Grant Scheme does not extend to the payment of tuition fees to institutions outside the State other than for exceptional provision in respect of postgraduate courses in Northern Ireland. In relation to tuition fees, there is provision for tax relief, at the standard rate in respect of approved courses at approved colleges of higher education including approved undergraduate and postgraduate courses in other E.U. Member States. Further details and conditions in relation to this relief are available from the Revenue Commissioners. If the student referred to by the Deputy wishes to have his eligibility for a grant assessed, he should make an online grant application to Student Universal Support Ireland at www.susi.ie.

School Curriculum

72. Deputy Jonathan O'Brien asked the Minister for Education and Skills if he has reconsidered the NCCA proposals on CSPE in order to ensure that all students receive civic education during their time in school; and if he will make a statement on the matter. [30446/14]

Civic education is an integral component of the new Framework for Junior Cycle. For example, one of the 24 'Statements of Learning', that encompass the key knowledge and skills that students will develop during their junior cycle, requires that all students will "value what it means to be an active citizen with rights and responsibilities in local and wider context". In addition, the 8 key skills which underpin the new Framework for Junior Cycle, include "working with others" whereby students should realise and experience how they can "contribute to making the world a better place". I recently approved a new short course in CSPE that has been developed by the National Council for Curriculum and Assessment (NCCA). This short course will be available to schools to implement, from this September, should they wish to do so as part of their Junior Cycle programme or they may continue to offer the current syllabus. Schools will choose from one or the other for the up-coming academic year 2014/2015. This new short course is in fact designed for 100 hours of teaching compared to less than 70 hours for the existing CSPE syllabus. The new short course aims to inform, inspire, empower and enable young people to participate as active citizens in contemporary society at local, national and global levels based on an understanding of human rights and social responsibilities. As with Junior Cycle, civic education is also reflected at Senior Cycle. As part of transition year, students are afforded the opportunity to further interrogate some of the themes encountered in CSPE at Junior Cycle. This is facilitated by the availability of resources and materials that have been developed by a number of NGOs, including Amnesty International, for use by transition year pupils. I have also indicated my intention to introduce 'Politics and Society' as a new optional Leaving Certificate subject. One of the objectives of the draft syllabus, which has been developed by the NCCA, is to develop 'a sense of care for others and a respect for and a valuing of diversity in all areas of human life within the parameters of human rights principles'. In addition, the draft syllabus is structured around four key areas. One of these areas is 'Active Citizenship'. The Politics and Society subject will be made available to schools once the NCCA has advised my Department on a number of outstanding issues.

Under the terms of my Department's Post Primary School Transport Scheme children are eligible for school transport where they reside not less than 4.8 kilometres from and are attending their nearest education centre as determined by my Department/Bus Éireann, having regard to ethos and language. Children who are not eligible for school transport may apply for transport on a concessionary basis only subject to a number of terms and conditions including the availability of spare seats on an existing service and payment of the annual charge. The family in question should liaise with their local Bus Éireann office if they wish to avail of transport on a concessionary basis for the 2014/15 school year. The terms of the School Transport Schemes are applied equitably on a national basis.

Since its establishment, QQI has been proactive in its engagement with education and training representative bodies. Specifically, it has engaged with Aontas, the Community Education Network (CEN) and the ICTU community sector. By their nature, community sector providers often have relatively small numbers of learners. This raises questions in relation to the multiple small providers engaged with QQI and the proliferation of quality assurance systems that operate to support this provision. QQI therefore continues to encourage these representative bodies to assist in reconfiguring providers in such a way that provides for the development of fewer, more robust and sustainable quality assurance systems which can support the programme delivery required for learners.

Responsibility for the delivery of a new 16 classroom school referred to by the Deputy has been devolved to the Office of Public Works. The project is at the early stages of architectural planning and is one of the school projects approved to proceed to construction in 2014/2015. When construction will commence will be dependent on the progress of the project through the various stages of design and the local authority planning process.

In June 2011, I announced that some 20 new post primary schools are to be established up to 2017 to cater for increasing demographics across a number of locations. That announcement did not include a proposal to establish a new school in the area referred to by the Deputy. My Department is currently analysing the latest demographic data on a nationwide basis to determine where further school accommodation might be needed. Where further new schools are being established, it will be open to all patron bodies, including Educate Together, to make an application for patronage in line with published criteria.

The National Council for Special Education, through its network of Special Educational Needs Organisers (SENOs), is responsible for the allocation of teaching staff and a quantum of Special Needs Assistant (SNA) support to schools, including special schools. The terms of circular 42/11 – Staffing in Special Schools, in conjunction with Circular 38/10 – Staffing Arrangements for Special schools and the role of the National Council for Special Education (NCSE) revises the annual teaching staff arrangements for special schools as from the 2012/13 school year, based on updated pupil profiles each year. This approach was adopted following discussions with management bodies, trade unions and the National Parent Councils. In effect, special schools are now staffed based on their actual current pupil profiles and disability category of each pupil, as opposed to primarily by school designation. School staffing schedules, to which the Deputy refers are reviewed and updated each year by the NCSE. The allocation of SNAs takes into account the assessed care needs of children qualifying for SNA support. The NCSE operates within my Department's criteria in allocating such support. The criteria by which SNA support is allocated to pupils is set out in my Department's Circular 0030/2014. The deployment of SNAs within schools is a matter for the individual Principal/Board of Management. SNAs should be deployed by the school in a manner which best meets the care support requirements of the children enrolled in the school for whom SNA support has been allocated. It is a matter for schools to allocate support as required, and on the basis of individual need, which allows schools flexibility in how the SNA support is utilised. Special Schools were notified of their teaching staff and SNA allocations for 2014/15 by NCSE in June. Details of the mechanism for schools/parents to appeal a decision in relation to the allocation of teaching staff and SNA support by the NCSE are available on the NCSE website at www.ncse.ie.

The Chief Executive Officer of the Residential Institutions Statutory Fund Board (Caranua) was selected following an open recruitment competition conducted by the Public Appointments Service (PAS). In accordance with the provisions of section 13 of the Residential Institutions Statutory Fund Act 2012 I designated the person selected by PAS to be the first Chief Executive of the Board. At its first meeting held on 27 March 2013, the person designated by me was appointed by the Board to be its first Chief Executive. The Chief Executive has extensive experience in the delivery, design and management of services for groups who are socially disadvantaged and immediately prior to her current appointment was an independent management and social policy consultant with public, voluntary and philanthropic bodies. I am not aware that any work she may have carried out in any of those capacities would give rise to a conflict of interest or impact on her ability to perform the functions associated with the position of Chief Executive of Caranua.

The National Council for Special Education (NCSE) is responsible, through its network of local Special Educational Needs Organisers (SENOs) for allocating a quantum of Special Needs Assistant (SNA) support for each school annually taking into account the assessed care needs of children qualifying for SNA support. The NCSE operates within my Department's criteria in allocating such support. The criteria by which SNA support is allocated to pupils is set out in my Department's Circular 0030/2014. The National Council for Special Education (NCSE) have allocated over 10,900 Special Needs Assistant (SNA) posts in schools to support students with special needs for the 2014/2015 school year. The exact numbers of SNAs will become clear when enrolments of students in mainstream schools are finalised in September. All students who are eligible to access SNA support and for whom an application has been made, will have this support in place in September. The deployment of SNAs within schools is a matter for the individual Principal/Board of Management. SNAs should be deployed by the school in a manner which best meets the care support requirements of the children enrolled in the school for whom SNA support has been allocated. It is a matter for schools to allocate support as required, and on the basis of individual need, which allows schools flexibility in how the SNA support is utilised. It is important to note that each school's allocation of SNA support can change from year to year and may be increased or decreased as students who qualify for SNA support enrol or leave a school. New students with care needs may, or may not, enrol to replace students who have left, for example, or SNA allocations may be decreased where a child's care needs have diminished over time. There is always a significant churn of posts within the system.Details of the mechanism for schools/parents to appeal a decision in relation to the allocation of SNA support by the NCSE are available on the NCSE website at www.ncse.ie.

I have had no contact with Dublin and Dun Laoghaire Education and Training Board on this matter. The decision is an executive function of the Chief Executive Officer of the ETB and it is not my role, as Minister, to intervene directly in the planning and delivery of services in an ETB.

In 2014 appointments were made to the following boards: Grangegorman Development Agency (GDA); Higher Education Authority (HEA); Quality and Qualifications Ireland (QQI); Residential Institutions Redress Board (RIRB); Residential Institutions Review Committee (RIRC); and Residential Institutions Statutory Fund (RISF). The Deputy should note that Board appointments, while made by me as Minister, are not in all cases made at my sole discretion.
