712. Deputy Catherine Murphy asked the Minister for Health his response to the claim by certain general practitioners with medical card contracts to the Rights Commissioner that they are entitled to be considered employees of the Health Service Executive; and if he will make a statement on the matter. Under the General Medical Services (GMS) Scheme's governing legislation, the HSE contract general practitioners (GPs) to provide services to eligible persons. The contract is one for services rather than employment, therefore, GPs are not employees but contractors. As GP contracts are with the HSE rather than the Department, I have referred this matter to the HSE for direct reply to the Deputy.
