549. Deputy Olivia Mitchell asked the Minister for the Environment, Community and Local Government if he will consider legislation similar to that in the United Kingdom limiting the height of trees in small suburban gardens; and if he will make a statement on the matter. [36474/14]
View answerThere is currently a civil remedy available concerning branches or roots of neighbouring trees encroaching on one's property. I will, however, give consideration to the proposal concerned with regard to trees acutely impacting on neighbouring properties in the context of the forthcoming review of legislation in this area within my Department. The UK model is one legislative option in this regard and will be taken into account in that context.
