Inland Fisheries

559. Deputy Seán Kyne asked the Minister for Communications, Energy and Natural Resources if Inland Fisheries Ireland carried out works on a stream (details supplied) in County Galway in May or June of 2013 without securing permission of owners and work which included banking of the sides of the stream with large stones; the reason the work was carried out; the person or section who authorised the works and if any investigation has been carried out in view of the fact that the lands adjoining the stream are now retaining water for longer. I am advised that the Lough Beag stream forms part of the Corrib catchment drainage programme which is managed by the Office of Public Works (OPW). I understand that this channel is monitored by OPW and also that the lower section of the stream is scheduled for drainage maintenance in 2015. I am further advised, as regards the concerns now expressed, that water levels in the Corrib catchment reached exceptionally high levels over the Winter / Spring of 2013/14 – and remained at that level due to high rainfall well through Spring 2014.

The in-stream structure upgrades were carried out by Inland Fisheries Ireland (IFI) in partnership with OPW.

I understand that the Lough Beag stream was identified by IFI as a channel with potential for improvement works aimed at increasing its productivity for wild brown trout production. This was part of the ongoing development programme of the Corrib catchment in conjunction with the Corrib Angling Federation and local angling clubs. I am advised that the works commenced in 2012 and were completed in 2013. These works focussed on upgrading existing in-stream structures with a view to improving fish habitat together with the introduction of gravel for trout to spawn in.

I understand that the work included rock deflectors and pools with stones for trout habitat designed to retain water only during low flow periods and to flood out in higher water. I am advised that the structures have no impact when the stream is in flood as the water drowns out the structures. This channel is indexed in the OPW drainage programme as C25 and as the stream is at lake (Lough Corrib) level it will consequently be directly influenced by the water levels in the Lake. I am advised that In-stream structures in this case are incidental in terms of flooding in times of high lake level.

It is understood that the lands in question are in the ownership of an individual who had given consent for the works to take place. I am also advised that during the programme of works the landowner regularly visited the site and engaged with staff on the programme.

In July, 2014 IFI were made aware of certain concerns in relation to the works – and an on-site meeting of relevant parties was arranged. IFI are keen to ensure that the responsibilities of the state (OPW and IFI) and the concerns of all involved including local landowners are addressed. I have asked IFI to liaise with the OPW to ascertain if the concerns raised by the Deputy are manifest in any deterioration in the ability of the river to discharge as designed.

As Minister for Transport, Tourism & Sport, I have responsibility for overall policy and funding in relation to the national roads programme.  The planning, design and implementation of individual road projects is a matter for the National Roads Authority (NRA) under the Roads Acts 1993 to 2007 in conjunction with the local authorities concerned.  

Within its capital budget, the assessment and prioritisation of individual projects is a matter in the first instance for the NRA in accordance with Section 19 of the Roads Act.

Details of my Department's regional and local road grant allocations and payments to local authorities Councils, including Meath County Council,  are outlined in the regional and local road grant booklets available in the Dáil Library.   

With regard to national roads, details of the allocations to each local authority (including Meath) are also available in the Dáil library.  Actual payments to local authorities are a matter for the NRA and I have, therefore, referred the Deputy’s question to the Authority for direct reply.

I understand that Fáilte Ireland recently launched a pilot Visitor Attraction Senior Management Programme. This  programme of continued professional development  was specifically designed for senior managers of high volume fee-based heritage visitor attractions.  

The Department of Transport Tourism and Sport has no role in the management or day to day running of such programmes. That is a matter for the board and management of Fáilte Ireland.  I have therefore referred the Deputy's question to Fáilte Ireland for direct reply.

One of the principal recommendations of the National Ports Policy, published in March 2013, is the proposed transfer of five Ports of Regional Significance to local authority control.

Government approved the Heads of the Harbours (Amendment) Bill 2014 in May. In recent weeks the Joint Oireachtas Committee considered the Heads and published a report of its recommendations and the Heads are now ready for preparation by the Office of the Parliamentary Counsel.

A copy of the Heads is available on my Department's website. The Bill will provide the necessary primary legislative basis to effect the transfers by later Ministerial Order. I anticipate bringing the Bill before the Oireachtas in 2015.

Officials have been meeting with ports, local authorities and others to discuss the proposed transfer arrangements and they will continue to engage with stakeholders as the drafting of the Bill progresses. The role of the Chief Executive who will exercise the shareholder function, and the role of the Councils in relation to the ports that will be transferred, is currently under discussion.

I refer the Deputy to a topical issue on fare increases which I answered on the 6th November, 2014. 

I remain strongly supportive of the efforts to secure the company’s financial sustainability in order to ensure that rail services can be provided efficiently and cost effectively.  The Government has provided substantial Exchequer investment in the rail network in recent years despite the significant financial challenges and is fully engaged with Irish Rail and the National Transport Authority (NTA) in examining the future funding requirements for the company to ensure a sustainable future.

I acknowledge the changes that have been delivered by workers to date and also the contribution made by them in accepting the Labour Court proposals of 3rd September last. The Labour Court also recommended that the Cost Management Committee, involving both management and employee representatives, should identify target savings in non-payroll items necessary to implement the company’s five year plan.

I also gave a commitment to no further reductions in the Public Service Obligation funding and, for the first time since 2008, the level of Public Service Obligation (PSO) for bus and rail services is being maintained in 2015 at current levels.
