227. Deputy Éamon Ó Cuív asked the Minister for Agriculture, Food and the Marine when payments will issue under the agri-environment options scheme for 2012, 2013 and 2014 in respect of a person (details supplied) in County Galway; the reason for the delay in issuing these payments; and if he will make a statement on the matter. The person named was approved for participation in the 2010 Agri-Environment Options Scheme (AEOS 1) with effect from 1 November 2010 and has received payment in respect of the 2010 and 2011 Scheme years.

However, for 2012 the relevant application under the 2012 Single Payment Scheme was not made until 19 December 2012 and, therefore, in accordance with regulations governing the scheme, it could not be processed as it was lodged more than twenty-five working days late.The person named appealed this decision to the Independent Appeals Committee, and the decision was upheld.

In accordance with the Terms and Conditions of the AEOS scheme, as a valid Single Payment Scheme application was not received, a 100% penalty will apply to the AEOS payment in respect of the 2012 scheme year . As a result, no payment will issue for that year.

My Department is currently processing the application in respect of 2013 and 2014.
