587. Deputy Terence Flanagan asked the Minister for Transport, Tourism and Sport the legislation that outlaws cycling on the footpath; his views on a matter (details supplied) regarding the Garda; and if he will make a statement on the matter. [49007/14]

Footpaths are restricted to pedestrians only, as defined in section 2 of the Roads Act 1993.  By definition, cyclists are therefore excluded from using footpaths.  

Under the terms of section 87 of the Road Traffic Act 2010, as amended, Gardaí, fire and ambulance services are exempt from a range of road traffic legislation while using vehicles.  While the definition of ‘vehicle’ in this context includes bicycles, the legislation from which the exemption applies is the Road Traffic Acts from 1961 onwards.  It does not provide an exemption from the Roads Act 1993.
