124. Deputy Bernard J. Durkan asked the Minister for Justice and Equality if a person (details supplied) in County Westmeath may visit a seriously ill relative in his home country and return to Ireland under his current residency status; and if she will make a statement on the matter. [3235/15]

I am advised by the Irish Naturalisation and Immigration Service (INIS) of my Department that the person concerned is the subject of a Deportation Order made on 5 August 2014. This Deportation Order was made following a detailed examination of the representations he submitted for consideration under Section 3 of the Immigration Act 1999 (as amended).

The Deputy might wish to note that the person concerned has never held a right of residency in the State since arriving in August 2006 and has a deportation order issued against them. Accordingly, there is no basis for them to return to the State if they decide to visit their home country.

The effect of a Deportation Order is that the person must leave the state and remain thereafter outside the state. The enforcement of Deportation Orders is an operational matter for the Garda National Immigration Bureau.

Queries in relation to the status of individual immigration cases may be directly to the INIS of my Department by e-mail using the Oireachtas Mail facility which has been specifically established for this purpose. This service enables up to date information on such cases to be obtained without the need to seek information by way of the Parliamentary Questions process. The Deputy may consider using the e-mail service except in cases where the response from the INIS is, in the Deputy’s view, inadequate or too long awaited.

I am informed by the Irish Naturalisation and Immigration Service (INIS) of my Department that immigration permission was granted to this person on 03 November 2014 and they were registered with the Garda National Immigration Bureau on foot of this on 02 December 2014.

Queries in relation to the status of individual immigration cases may be made directly to the INIS by e-mail using the Oireachtas Mail facility which has been specifically established for this purpose. This service enables up-to-date information on such cases to be obtained without the need to seek information by way of the Parliamentary Questions process. The person concerned was informed on 13 October 2014 of my intention to grant his application for a certificate of naturalisation. The required documentation has recently been received and the person concerned will be invited in due course to attend the next available citizenship ceremony, at which he will make a declaration of fidelity to the Irish Nation and loyalty to the State and receive his certificate of naturalisation.

I have been informed by the Irish Naturalisation and Immigration Service of my Department that correspondence was received on 15th December 2014 from the person referred to by the Deputy in respect of an application for Family Reunification. A letter issued on 2nd January 2015 from my Department requesting further information. No reply has been received to date.

The Health Service Executive has been asked to examine this matter and to reply to the Deputy as soon as possible.

The Health Service Executive operates the General Medical Services scheme, which includes medical cards and GP visit cards, under the Health Act 1970, as amended. It has established a dedicated contact service for members of the Oireachtas specifically for queries relating to medical cards and GP visit cards, which the Deputy may wish to use for an earlier response. Contact information has issued to Oireachtas members.

If the Deputy has not received a reply from the HSE within 15 working days, please contact my Private Office who will follow up the matter with them.
