Appointments to State Boards

103. Deputy Mary Lou McDonald asked the Minister for Justice and Equality to provide details on the number of senior civil servants who retired since 2011 in her Department and who have been appointed to a State board under her aegis following retirement; if she will provide in tabular form the names of these persons, the boards to which they were appointed and the appointment process followed in each case; and if she will make a statement on the matter. I am interpreting the Deputy’s question in a broad manner so as to provide the information which I believe she is seeking. The term 'State Boards' is somewhat imprecise as it includes bodies with a wide and diverse range of functions many of which would not fall into the more commonly understood definition of Board which is a body with a governance oversight of an organisation. To be of assistance to the Deputy I have interpreted her question as embracing all bodies called Boards, irrespective of their functions, as well as other bodies with a governance remit whose title does not include the term “Board”. In addition, the Deputy should note that I have interpreted "senior civil servants" to refer to those at Principal Officer grade (or equivalent grade) or higher on retirement.

I wish to inform the Deputy that one retired senior civil servant has been appointed to a State Board under the aegis of my Department during the period to which she refers. Mr. Willie Connolly, a retired prison governor, was appointed to serve on the Parole Board on 17 July 2012.

The Educational Welfare Service has specific responsibility for the Child and Family Agency’s statutory function to ensure that each child attends a recognised school or otherwise receives a certain minimum education.

Section 24 of the Education (Welfare) Act 2000 provides: “Where the board of management of a recognised school or a person acting on its behalf is of the opinion that a student should be expelled from that school it shall, before so expelling the student, notify the educational welfare officer to whom functions under this Act have been assigned, in writing, of its opinion and the reasons therefor”.

The Act further provides that the Agency make all reasonable efforts to ensure that provision is made for the continued education of such students. Although each school must notify the local Educational Welfare Officer of the intention to expel, the Agency has advised me that it does not collate the particular data requested by the Deputy at this time. The latest available figures indicate that 26 students were excluded from primary schools in the academic year 2011/2012. 186 students were excluded from post primary schools in the same period.

Deputy Robert Troy asked the Minister for Children and Youth Affairs in respect of the €8,664,012.21 expended on guardians ad litem in 2014 to set down the number of persons receiving such payments in 2014; and if he will provide details in tabular form by decreasing value of the total payment made to each guardian ad litem in 2014. Under the Child Care Act 1991, as amended, the Child and Family Agency has responsibility for payment of any costs incurred by a person who has been appointed by a court to act as a guardian ad litem in proceedings under the Act.

The Agency has informed me that its financial system does not provide the ability to obtain, from invoices from guardian ad litem organisations, the number of individual guardians ad litem involved. It has further advised that the nature of the guardian ad litem payments are to settle invoices received from individual guardians ad litem or guardian ad litem organisations for services provided in accordance with their appointment by the Courts in family law proceedings.

I propose to take Questions Nos. 107 to 110, inclusive, together.

My Department administers a range of funding schemes and programmes to support the provision of youth services to young people throughout the country including those from disadvantaged communities. The funding schemes support national and local youth work provision to some 380,000 young people and involve approximately 1,400 youth work staff in 477 projects and 40,000 volunteers working in youth work services and communities throughout the country. In 2015, funding of €49.93m has been provided to my Department for these schemes. The funding for these schemes is administered, in the main, by the Education and Training Boards on behalf of my Department.

My Department has robust financial control and governance procedures in place, in line with its accountability for public funding and the provision of services for young people. Mechanisms have been put into place to ensure best practice. These include compliance and reporting obligations to be met by organisations that receive funding from my Department, financial, audit and governance reviews, where appropriate and other procedures. Education and Training Boards are expected to take a pro-active approach to ensure that youth projects funded by my Department demonstrate appropriate governance arrangements to deliver on these objectives. Within each Education and Training Board area, Youth Officers are the point of contact for projects in respect of application, monitoring reporting and compliance matters. This responsibility may involve the examination of documentation or verification visits to individual projects, generally by appointment. The number and frequency of such visits is a matter for each Education and Training Board, in accordance with their financial and governance procedures and their knowledge at local level. My Department does not have readily available the names of youth projects throughout the country that have been the subject of examination in line with these procedures in 2014.

I am advised that the project in question has been allocated €121,087 by my Department in 2015. The funding of the project is administered by the City of Dublin Youth Services Board of the City of Dublin Education and Training Board. I have arranged for the matters raised to be brought to the attention of the City of Dublin Youth Services Board. I will revert to the Deputy when the information is to hand.
