188. Deputy Michael McGrath asked the Minister for the Environment, Community and Local Government the number of times, and the percentage of overall decisions this represents, where An Bord Pleanála made a decision against the recommendation of its inspector for each of the years 2012 to 2014, inclusive; if he will confirm the obligation on the board to set out the grounds on which the inspector's recommendation has not been accepted; and if he will make a statement on the matter. The information requested by the Deputy is provided in the table below. Section 34(10) of the Planning And Development Act 2000 -2014 provides that , where a decision by the Board to grant or refuse permission is different, in relation to the granting or refusal of permission, from the recommendation in a report of a person assigned to report on an appeal on behalf of the Board, a statement giving the reasons on which the decision is based shall also indicate the main reasons for not accepting the recommendation in the report to grant or refuse permission.

Housing Assistance Payments Implementation

189. Deputy Brian Stanley asked the Minister for the Environment, Community and Local Government when the housing assistance payment scheme will be introduced in County Laois. [12301/15]

The implementation of the Housing Assistance Payment (HAP) is a key Government priority and a major pillar of the Social Housing Strategy 2020, which I published on 26 November 2014. The HAP scheme will bring all social housing supports provided by the State under the aegis of local authorities. The scheme will remove a barrier to employment by allowing recipients to remain in the scheme if they gain full-time employment. HAP will also improve regulation of the rented accommodation being supported and provide certainty for landlords as regards their rental income.

Further to the enactment of the Housing (Miscellaneous Provisions) Act 2014 on 28 July 2014, the first phase of the HAP statutory pilot commenced with effect from 15 September 2014 in Limerick City and County Council, Waterford City and County Council and Cork County Council. HAP commenced in Louth, Kilkenny, South Dublin and Monaghan County Councils from 1 October. Subsequently, on 18 December, Dublin City Council became part of the statutory HAP pilot, with a specific focus on accommodating homeless households. Dublin City Council is implementing the HAP pilot for homeless households in the Dublin region on behalf of all 4 Dublin local authorities, including Dún Laoghaire Rathdown County Council.

There are now over 1,200 households in receipt of HAP across the local authority areas taking part in the statutory pilot scheme.

During the legislation's passage through the Oireachtas in July 2014 an undertaking was given that a report would be prepared for the relevant Oireachtas Committee. Data for this report is being gathered from pilot sites and a progress report will be submitted to the Oireachtas Committee on Environment, Culture and the Gaeltacht shortly. Based on data gathered for the review, consideration is currently being given to the sequencing of local authorities to commence HAP on an incremental basis this year.

Foreshore Licence Applications

Deputy Pearse Doherty asked the Minister for the Environment, Community and Local Government if he has received an application from Donegal County Council for a foreshore licence for a beach (details supplied) in County Donegal; his plans to sanction this foreshore licence; and if he will make a statement on the matter. I have approved the application from Donegal County Council in respect of proposed dredging at Magheraroarty Pier and re-use of the dredged material at nearby Dooey Strand. The draft licence is in the final stages of execution and I expect the sealed licence to issue soon.

Social and Affordable Housing Eligibility

Deputy Michelle Mulherin asked the Minister for the Environment, Community and Local Government if he will address the anomaly whereby a person or couple in serious mortgage arrears who voluntarily surrender their home to a bank because of their inability to pay are deemed disqualified from being housed by their local authority, even though they have no other home and have very little choice in this regard; and which anomaly is an impediment for some distressed borrowers in trying to sort out the issue of mortgage arrears on their homes expeditiously without lengthy court proceedings; and if he will make a statement on the matter. For a household to qualify for social housing support a housing authority must carry out an assessment to establish whether the household is in need of housing and meets certain eligibility criteria, including income limits. As part of a concerted effort to deal with the issue of mortgage arrears, the Social Housing Assessment Regulations were amended in 2011 to provide that a household may be determined to be in need of housing if it has a mortgage that is deemed to be unsustainable under the Mortgage Arrears Resolution Process.

Plastic Bag Levy

Deputy Thomas Pringle asked the Minister for the Environment, Community and Local Government the amount that has been collected in each of the past three years through the plastic bag levy; if he will provide, in tabular form, the amount that each local authority has received from the funding; and if he will make a statement on the matter. The amounts raised by the Plastic Bag Levy are available and contained in the published accounts of the Environment Fund, available on my Department's website at: http://www.environ.ie/en/Environment/Waste/EnvironmentFund/. The 2014 Accounts have not yet been finalised.

The proceeds of the environmental levy on the supply of plastic bags, collected by the Revenue Commissioners, and the environmental levy on the landfilling of waste, collected by local authorities, are both paid into the Environment Fund. The Environment Fund was established by the Waste Management (Amendment) Act 2001 with effect from 17 July 2001, to be managed and controlled by the Minister for the Environment, Community and Local Government.

Funding from the Environment Fund can be used for activities or initiatives in a range of areas such as, inter alia:

- schemes to prevent/reduce waste and waste recovery activities;

- research & development into waste management;

- production, distribution or sale of products deemed to be less harmful to the environment than other similar products;

- development of producer initiatives to prevent/reduce waste arising from their activities;

- promotion of awareness of the need to protect the environment, including national and regional campaigns;

- promotion/support of education and training to assist achievement of campaign objectives;

- initiatives undertaken by community groups and others for protection of the environment;

- initiatives undertaken by international organisations and others for protection of the environment and/or sustainable development; and

- such other purposes for the protection of the environment as may be prescribed by the Minister in regulations.

Details of expenditure from the Environment Fund, including expenditure across the local government sector, are also contained in the published accounts of the Environment Fund at the link above. However, a breakdown of all expenditures by local authority is not available.
