Single Payment Scheme Appeals

Question:

78. Deputy Paul J. Connaughton asked the Minister for Agriculture, Food and the Marine the reason a person (details supplied) in County Galway has not received arrears under the single payment scheme in view of the fact that the person was informed in January 2015 that the penalty review was successful; the reason for the delay; when the moneys will be paid; and if he will make a statement on the matter. A review of the land parcels declared by the person named under the 2009 Single Payment Scheme revealed that land parcels declared by the person named contained ineligible features. The person named was notified of the decision to reduce the reference area of the parcel and the resultant penalty on 11 July 2013. This letter also advised the person named of his right to appeal this decision and an appeal was received by my Department from the person named on 5 September 2013.

Following a review of the case, it was decided to partially allow the appeal and issue a refund to the person named accordingly. The person named was advised of this decision by letter of 12 January 2015. This letter also advised that if the person was dissatisfied with this decision they could appeal to the independently chaired LPIS Appeals Committee. The person named has not availed of this right to date. Arrangements will be put in place to issue the refund due to the person named as soon as possible.

Agri-Environment Options Scheme Payments

79. Deputy John O'Mahony asked the Minister for Agriculture, Food and the Marine when a person (details supplied) in County Galway will receive payment on an agri-environment options scheme 3; and if he will make a statement on the matter. [15957/15]

The persons named were approved for participation in the 2012 Agri-Environment Options Scheme (AEOS 3) with effect from the 1st May 2013 and payment has issued in respect of the 2013 Scheme year. Under the EU Regulations governing the Scheme and other area-based payment schemes, a comprehensive administrative check, including cross-checks with the Land Parcel Identification System, must be completed before any payment can issue.

The application was selected for a ground inspection which took place on the 5th December 2014. During this inspection non-compliances with the Terms and Conditions of the scheme were noted in relation to the Water Trough, Traditional Stonewall Maintenance and Riparian Margin actions, which resulted in a penalty being incurred. The file is currently being processed on the basis of the inspection findings with the intention of issuing payment in respect of 2014, minus penalty as soon as possible.

Deputy Maureen O'Sullivan asked the Minister for Defence if he will provide a list of the inventory of both weapons and equipment in use by the Defence Forces, currently produced by Israel and purchased from Israeli industrial bodies, which have been purchased and are in use by the Irish Defence Forces in line with European Union procurement rules which abide by international embargoes and treaties; and if he will make a statement on the matter. Prisoner Transport

81. Deputy Fergus O'Dowd asked the Minister for Justice and Equality the annual cost of transporting persons committed to prison for the non-payment of fines from 2010 to 2013; and if she will make a statement on the matter. [15834/15]

As outlined in my reply to the Deputy to Parliamentary Question No. 340 of Wednesday, 15th April, 2015 persons committed to prison are transported by Garda vehicles as part of their routine duty and not separately accounted for. I am further informed that the annual cost pertaining to the transport of persons committed to prison using Garda personnel and vehicles for the non-payment of fines is not readily available and would require an inordinate amount of administrative resources to obtain this level of detail.

However, for the sake of completeness as regards the use of other methods of conveyance of persons detained where deemed operationally expedient by the Commissioner, I am advised the annual cost of these services from 2010 to date is as follows. I am further advised that the reduction from 2012 to date was due to the greater availability of Garda vehicles for the conveyance of persons committed to prison.

I am advised by the Irish Naturalisation and Immigration Service (INIS) of my Department that the application, by the person concerned, for residence under the Free Movement provisions is currently under examination. Due to the circumstances particular to this case, further documentation was requested in support of the application on 18th March, 2015. Officials in INIS have advised that, following receipt of the requested documentation on 30th March 2015, a decision will be made very shortly on the case.
