Consular Services Provision

Seán Crowe

Question:

398. Deputy Seán Crowe asked the Minister for Foreign Affairs and Trade his views on concerns for the well-being of an Irish citizen (details supplied) who was arrested in the Philippines in July 2013, given that the person and his family strongly maintain his innocence, and that he was sentenced to 12 years in prison, but is currently out on bail; if his Department is providing the person with consular assistance; and if he has discussed the issue with his Filipino counterpart. My Department is aware of this case and has been providing consular assistance to the citizen and his family since July 2013.

The Embassy of Ireland in Singapore, which is accredited to the Philippines, as well as the Honorary Consulate General in Manila have provided ongoing assistance to this citizen, including providing a list of lawyers; making representations to the prison service on the citizen’s welfare after the person was detained; and facilitating the safe retrieval of personal belongings after the person’s release on bail.

It is important to bear in mind the role of the Irish Government where citizens are imprisoned abroad. When an Irish citizen is charged with an offence under the law of a foreign country, it is the foreign law that applies and it is the relevant foreign court which decides matters such as bail. As the Deputy will be aware the Irish Government cannot intervene directly in matters before foreign courts.

The Department of Foreign Affairs and Trade will continue to provide consular assistance as necessary and to make appropriate representations to the government of the Philippines to request that the citizen’s appeal be processed as soon as possible.

Israeli Settlements

399. Deputy Seán Crowe asked the Minister for Foreign Affairs and Trade if he is aware that the Israeli Government has approved the building of 900 new illegal colonial settlement units in east Jerusalem, that this is in complete violation of international law, and that it is exacerbating the huge tension in the region, and is clearly working against a two-state solution; if he will raise concerns with his Israeli counterpart; and in view of continued expansion of illegal settlements, if he will officially recognise the State of Palestine. I have very clearly expressed my condemnation of Israeli settlement expansion in the occupied Palestinian territory on a number of occasions, and I have also focused strongly on this issue in discussions at EU level and bilaterally. The issue informed our discussions at the Foreign Affairs Council in Brussels yesterday. It is clear that continued settlement expansion is gravely damaging to the prospects for a peaceful resolution of the conflict. I will continue to raise this issue. Israeli authorities are in no doubt whatever of our strong views on the issue. The question of recognition of Palestine, or of any state, is an important issue to be considered on its own merits, and not as a punishment or reward for one side or the other.

Cyprus Reunification

400. Deputy Seán Crowe asked the Minister for Foreign Affairs and Trade if he is aware of recent elections in northern Cyprus, and that the newly elected leader, Mr. Mustafa Akinci, has strongly stated that he wants reconciliation, and an agreement on the reunification of Cyprus; if he has spoken to his Cypriot counterpart on the issue; and if he will inform his Cypriot counterpart of his support for the resumption of peace talks, which begin on 15 May 2015. Ireland fully supports the aim to find a solution that provides for a comprehensive settlement in Cyprus, based on a bicommunal, bizonal federation with political equality, as set out in the relevant UN Security Council resolutions. Ireland remains supportive of all efforts to assist in the search for a mutually acceptable settlement to this long-standing problem. In this context, the resumption of the negotiations last Friday between the leaders of the two communities in Cyprus is very much to be welcomed. I was pleased to see that President Anastasiades welcomed the choice of Mr Mustafa Akinci as the new leader of the Turkish Cypriot community and that Mr Akinci has said that he is eager to bolster an atmosphere of trust between the two communities.

This, I hope, is an encouraging sign for the outcome of the negotiations ahead. As Special Adviser Eide, the UN facilitator, has said, the resumption of talks ‘is a unique opportunity’. I share his hope that it is ‘an opportunity that will be grasped’ and I understand that discussions have begun in an open and constructive way.

I wish both leaders well in their on-going negotiations, and hope that the goodwill expressed on both sides results in a sustainable, peaceful solution.

While I have not yet had the opportunity to discuss the issue directly with my Cypriot colleague, my officials have on-going dialogue with representatives of the Cypriot Government, including through our respective Embassies, and our support for the peace talks is long understood and appreciated.

Good Friday Agreement

402. Deputy Brendan Smith asked the Minister for Foreign Affairs and Trade his views on plans to scrap the Human Rights Act in the United Kindgom, and the possibility of this breaching the Good Friday Agreement; and if he will make a statement on the matter. [19601/15]

The commitment of Ireland to the promotion and protection of human rights is an underlying principle of Ireland’s foreign policy and is a priority for the Government. Ireland is currently a member of the United Nations Human Rights Council and we pursue our human rights priorities in many international fora. Ireland is a firm supporter of the European Court of Human Rights and the European Convention of Human Rights system and liaises regularly with the UK in relation to the Council of Europe Committee of Ministers’ supervision of states’ implementation of Court judgments. I should note clearly at the outset there is not at this time any legislation before the British Parliament at Westminster to repeal the 1998 UK Human Rights Act. Indeed the new British Government has not yet published its legislative programme for this parliamentary term, although it is expected to do so later this month. In the absence of any detailed proposal it is difficult to speculate on potential consequences. Obviously were any proposal to be made it would have to be carefully analysed. On the broad question of human rights and the Good Friday Agreement, the views of the Government are clear and unchanged. The protection of human rights in Northern Ireland law, predicated on the European Convention of Human Rights, is one of the key principles underpinning the Agreement. As a guarantor of the Good Friday Agreement, the Government takes very seriously its responsibility to safeguard its institutions and principles. The fundamental role of human rights in guaranteeing peace and stability in Northern Ireland cannot be taken for granted and must be fully respected. The Good Friday Agreement is clear that there is an obligation to incorporate the European Convention on Human Rights into Northern Ireland law and this is an ongoing obligation.

Placing human rights at the heart of the peace process in Northern Ireland has helped to ensure the participation and trust of all communities. A shared emphasis on human rights and all that this implies is part of what makes the peace process credible and effective. The Government will work closely with the UK Government and with the power-sharing Executive in Belfast to ensure that the protection of human rights remains at the heart of civic life, politics and ongoing societal change in Northern Ireland.

We will follow closely all developments in this regard. I plan to raise this matter with the Secretary of State for Northern Ireland when I meet her later today.

Human Rights Issues

I am aware of the advocacy work by a number of international NGOs in relation to this difficult case, including by Amnesty International. While we do not interfere in the internal judicial proceedings of other countries, we would of course urge that the case be resolved in accordance with Mexican law. The promotion and protection of human rights is a core principle of Ireland's foreign policy and we have prioritised the protection of trades unionists, human rights defenders and others who are in immediate danger. Our Embassy in Mexico participates actively in the EU-Mexico Human Rights Dialogue, which took place most recently in Mexico City on 15-16 April. In addition to consulting with civil society organisations, EU and Mexican human rights experts discussed a wide range of human rights issues, including challenges relating to the rule of law, the fight against impunity, and human rights defenders. The Embassy also maintains an active dialogue with international and local civil society partners in Mexico, including Amnesty, on a range of development and human rights issues.

Deputy Tom Fleming asked the Minister for Education and Skills if she will examine an application in respect of a school (details supplied) in County Kerry for a general purpose room, which will finalise the development project, as per plans submitted to her Department; and if she will make a statement on the matter. As the Deputy is aware the school was approved funding, on a devolved basis, in December 2014 last for the provision of three general classrooms, one resource room and ancillary accommodation to replace existing prefabs. Funding was also provided for the associated prefab removal costs. The school subsequently requested that the project approved would be reviewed to allow the provision of two specialist rooms instead of two general classrooms, as previously agreed. I wish to advise the Deputy that the revised application from the school did not include for a General Purpose room. The revised application is currently under consideration by my Department and a decision will be conveyed to the school, in question, in due course.

The records maintained by my Department in respect of large scale building projects are retained on a county basis. The first table provides a list of new schools and large scale extensions/refurbishments in Dublin that were completed in the period 2011 to 2014. The five year plan for new schools and large scale extensions was announced in March 2012 and information in respect of these schools is available on my Department's website and this information is updated on a monthly basis. The most recent updates to the appropriate files are included in the tables numbered 1 to 7. Under the Infrastructure and Capital Investment Framework 2012-2016 announced in November 2011, a total of €1.5 billion funding is assigned to the delivery of new schools and large scale extensions.

Deputy Alan Shatter asked the Minister for Education and Skills in relation to Dublin South constituency, the number of pupils currently attending primary school or secondary school in 2015, compared to 2010; in respect of each school, the enrolment numbers expected in September 2015; in respect of each school, as compared to 2011, the current number of teachers, resource teachers, and special needs assistants; and in respect of each school, the numbers sanctioned for the next school year. Data on the number of pupils enrolled in each school are available on the Statistics Section of my Department's website at http://www.education.ie/en/Publications/Statistics/Data-on-Individual-Schools/. The most recent published information is provisional data for the 2014/2015 school year. Final data in relation to the 2014/15 school year will be published later in the current school year.

The teacher allocation and redeployment process for the 2015/16 school year is currently underway in my Department. The allocation processes at both primary and post primary level also include an appeals mechanism under which schools can appeal against the allocation due to them under the staffing schedules. The Appeal Boards operate independently of the Department and their decisions are final. The final staffing position for all schools at primary and post primary level will ultimately not be known until the Autumn. At that stage the allocation process will be fully completed and any appeals to the Staffing Appeal Boards will have been considered.

The National Council for Special Education (NCSE) is responsible, through its network of local Special Educational Needs Organisers (SENOs), for allocating resource teaching and Special Needs Assistant (SNA) support to schools to support children with special educational needs and additional care needs respectively. The NCSE operates within my Department's criteria in allocating such support.

As part of Budget 2015, I announced that an additional 365 Special Needs Assistant (SNA) posts are being provided for in 2015, as well as an additional 480 Resource Teachers, to take into account increased demand and demographic growth and to ensure that children can continue to have access to additional supports in school. This is the highest number of Resource Teaching and SNA support that we have ever had.

These increases, building on increases which have already been provided in recent years, will ensure that children with special educational needs can continue to participate in education and be supported in a manner appropriate to their needs.

Details of resource teaching and SNA allocations which have been made to each school for 2014/15 are available on the NCSE website www.ncse.ie.

The NCSE is currently processing applications from schools for resource teaching and SNA support for the coming school year. Schools will be notified of their 2015/16 allocations shortly.

I will arrange to have the Deputy's question forwarded to the NCSE for their direct reply in respect of information which has been requested regarding allocations to schools in 2011.

Equality Issues

Deputy Jonathan O'Brien asked the Minister for Education and Skills if she is aware that SIPTU has advised its members on the National University of Ireland Galway campus not to co-operate with the university's gender task force, as it was not engaged in consultations regarding its establishment; that there are concerns that the task force lacks transparency, and was not independently constituted, and no assurances have been provided with regard to confidentiality; and her plans to urgently address these matters. The very serious shortcomings identified by the Equality Tribunal in its ruling last November in the case of Dr. Micheline Sheehy Skeffington must be acknowledged. Discrimination against women in the workplace is unacceptable in any setting and the issues brought to light in that case are of serious concern to me. For that reason, I have welcomed the response of NUI Galway in unreservedly accepting the ruling of the Tribunal and in establishing a Task Force to address related issues.

However, it is important that this taskforce has the confidence of both the student body and the staff. I am aware of concerns about the proposed composition of the taskforce in Galway. I want to repeat my view that having the broadest possible support for the taskforce at the outset is central to its important work, and I would urge NUIG to ensure that every effort is made to achieve that goal.

More broadly, the Higher Education Authority is actively considering how best to support the improvement of gender equality across the Irish higher education system as a whole and is developing a database of staff employed in the sector, so that we can ensure gender-equality at all levels within the academic profession in Ireland becomes a reality.

SOLAS Funding

The payment of an additional training allowance of €31.80 per week for the long term unemployed was introduced during a period of high employment levels as an incentive for the long term unemployed to participate in former-FÁS training courses and VTOS courses. The payment of this allowance was later extended to those persons in receipt of social welfare disability payments to introduce equality of treatment for all people in training.

The payment was reduced from €31.80 per week to €20 per week as part of Budget 2011 and as part of Budget 2014 it was decided to cease this payment for all SOLAS participants commencing courses after 1st January 2014.

The cost of re-instating this long term bonus payment is estimated at €6.7 million in a full year.

I wish to advise the Deputy that my focus in Budget 2015 was on obtaining the additional funding that was necessary to provide for demographic growth. The last Budget included an increase in spending on education for the first time in recent years, amounting to additional funding of €60m during 2015. This funding will be used to provide 1,700 additional teachers and SNAs for our schools, as well as to fund prioritised reforms, such as implementation of the literacy and numeracy strategy, reform of junior cycle, and the introduction of education focussed pre-school inspections. The improvements in the Primary Staffing Schedule for small schools which I announced in February last are the only changes that I will be making to the staffing arrangements for schools for the 2015/16 school year.

I also wish to advise the Deputy that an additional 365 Special Needs Assistant (SNA) posts have been provided for in 2015, as well as an additional 480 Resource Teachers, which takes into account increased demand and demographic growth.

11,300 SNA posts are available for allocation in 2015. 6705 resource teaching posts are also available to the NCSE to allocate to schools. This is the highest number of Resource Teaching and SNA support that we have ever had and has ensured that children can continue to have access to additional supports in school.

The number of posts which will be required for allocation in future years will be considered as part of the annual budgetary and estimate process which takes place each year.

The Deputy will also be aware that the National Council for Special Education (NCSE) has recommended the development of a new model for delivering teaching resources to schools to support students with special needs.

Through consultations, there was a broad welcome for the proposed new model from Parents, disability groups, schools and stakeholders. However, there has not been sufficient time to address all of the concerns which have been raised in advance of the 2015 school year.

My Department is, however, continuing to develop the new allocation model for schools and is currently working to devise a pilot of the new model. Issues regarding the number of resource teachers which will be required in future years will therefore be considered in the context of the development of a new allocation model.

The Government's approach to restoring the economy has helped Ireland to return to a position where we are seeing economic growth. It is a continuing improvement in our economic growth over a sustained period that will enable us to move to a point where we can look again at providing for additional teacher resources in schools which could bring about further improvement in PTR, class size and support for classroom teachers.

Capitation Grants

The last Budget included an increase in spending on education for the first time in recent years, amounting to additional funding of €60 million during 2015. That increase has provided funding for 1,700 additional teachers and SNAs to be recruited for our schools, as well as funding important reforms. However, it was not possible to secure the funding which would be required to also increase the rates of capitation paid to our schools.

The school funding measures introduced in Budget 2011 provided for a 5% reduction in funding for capitation and related grants to primary and second level schools. This was applied to schools by a 5% reduction across the range of per capita grants.

The multi annual school funding measures introduced in Budget 2012, provided for a 6% overall reduction in the funding for capitation and related grants to primary and second level schools. The reduction was introduced on a phased basis and applied by a 2% reduction in 2012 and 2013 and a further reduction of 1% in 2014 and 2015.

In total these measures have resulted in capitation and related funding to the primary and second level school sector being reduced by 11%. Increasing overall funding at present would cost approx. €3.7m per percentage point.

I am determined that education will be prioritised for further investment in future years, and I believe that increasing the staffing and funding of our schools should be priorities for such investment.

The management authority of the school referred to by the Deputy submitted an application for funding under my Department's Emergency Works Scheme to replace windows at their school.

As replacement of windows is outside the terms of the scheme it cannot be considered for funding. The school authority has been requested to submit a revised application to address immediate health and safety issues only. As soon as this application is received it will be assessed and the school authority notified of the outcome.
