363. Deputy Michael Creed asked the Minister for Agriculture, Food and the Marine if he will clarify the detail of an alleged overpayment in a 2012 disadvantaged areas payment in respect of a person (details supplied) in County Cork; if this alleged overpayment has been appealed; if so, the outcome of same; if he is satisfied that his Department has not already recouped this overpayment; and if he will make a statement on the matter. A review of the land parcels declared by the person named under the 2013 Single Payment Scheme revealed that one of the land parcels declared by the person named contained ineligible features. However, while the person named was notified of this decision and of his right of appeal, to date no such appeal has been received. It remains open to the person named to appeal, should he so wish. These area reductions resulted in a reduction between 3% and 20% to the area payable under the 2012 Disadvantaged Areas Scheme, which resulted in an overpayment of €143.97 being generated on 26 May 2015, which will be recovered against future payments made by my Department.
