Question:

77. Deputy Robert Dowds asked the Minister for Finance if he, as representative of Allied Irish Banks' largest shareholder, will request senior management of the bank to reconsider its decision to outsource the application development management division; and if he will make a statement on the matter. As the Deputy will be aware under the Relationship Frameworks the State does not intervene in the day to day operations of the banks in which it holds investments or their management decisions regarding commercial matters and hence any discussions around matters such as outsourcing are a matter for the bank, the relevant staff and their union representatives. Notwithstanding this position, my officials do take an active interest in how the bank's cost base evolves to ensure that the State's interests as shareholder are protected and to ensure that the Government's remuneration policy is enforced. 

I have been informed that AIB has today announced plans to outsource additional IT Services to third party providers and will now enter into formal consultation processes with employee representatives as required both by law and in line with engagement principles agreed with the IBOA.

I have been further informed that the companies involved in the proposed outsourcing are establishing Delivery Centres in Ireland (in consultation with the IDA). Both organisations are committed to expanding their operations in Ireland to service their Global clients and one of these already provides IT Services to AIB. The bank also advises that there are no planned compulsory redundancies as part of this activity.

NAMA Assets Sale

78. Deputy Michael McGrath asked the Minister for Finance if he will provide details of the background to the sale of the Spawell complex in Templeogue in Dublin 6W; if he will specify the National Asset Management Agency's role in the sale; his views on whether section 2(b)(viii) concerning the purpose set out in the National Asset Managment Agency Act 2009 to contribute to the social and economic development of the State was adhered to in this case; if a sale to the Gaelic Athletic Association was considered in line with the agency's mandate; and if he will make a statement on the matter. As the Deputy is aware, NAMA has acquired and manages loans and is not the owner/operator of properties. The Agency's role is that of a secured lender. Other than properties that have been enforced, all of which are listed on NAMA's website and which are managed by the appointed receivers/administrators, properties continue to be managed by their existing owners or their professional managers/agents.  NAMA, nonetheless, in accordance with its statutory obligations, takes a very close interest in their efficient management and sale with a view to maximising loan repayment and thereby protecting the position of the taxpayer.

I am advised by NAMA that the particular property referenced by the Deputy was sold, following a competitive open market process, by the duly appointed Receiver. NAMA did not sell the property.  As the Deputy will be aware, in cases of enforcement, receivers are appointed as agents of the borrower and are obliged to achieve the highest price possible on the sale of properties on behalf of the borrower.

The Receiver in this instance could not have accepted a lower bid for the property simply on the basis that the bid was received from a sporting organisation.  If he had done so, the Receiver could have been exposed to litigation.  It is important to note that there is no provision for NAMA, a receiver or an administrator to allow for the sale of assets at a price below the highest bid/market value as to do so would run counter to NAMA's commercial obligations under Section 10 of the NAMA Act to optimise the proceeds from its loan portfolio to the benefit of all taxpayers.

In the context of its overriding commercial mandate as delineated by Section 10 of the NAMA Act and its ancillary objectives under Section 2 of the NAMA Act, NAMA seeks to manage its loan portfolio in a way that complements the objectives of other public bodies, namely Government departments, State agencies and local authorities.  I am advised that in circumstances where such public bodies initiate engagement with NAMA and indicate an interest in acquiring a specific asset which is for sale, NAMA, wherever feasible, affords the public body first option on the acquisition at the independently assessed market value of the asset.  NAMA has widely publicised its policy in this respect and has facilitated a number of very important transactions in areas such as social housing, education and healthcare provision. Deputy Jerry Buttimer asked the Minister for Finance if he will consider introducing a lower rate of excise duty on low alcohol beers to incentivise the production of such products and to encourage persons to consume products with a lower alcohol content; and if he will make a statement on the matter. Chapter 1 of Part 2 of the Finance Act 2003 (as amended) provides that the rate of Alcohol Products Tax (APT) on beer exceeding 0.5% alcohol by volume (ABV) but not exceeding 1.2% is €0.00, the rate of APT on beer exceeding 1.2% ABV but not exceeding 2.8% ABV is €11.27 per hectolitre per cent of alcohol in the beer, and the rate of APT on beer exceeding 2.8% ABV is €22.55 per hectolitre per cent of alcohol in the beer.

Accordingly, the level of excise duty imposed on a pint of beer of 2.8% ABV is 18 cents while the level of excise duty imposed on a pint of beer of 2.9% ABV is 37 cents.

The lower rate of duty on low alcohol beer was introduced in Budget 2009 to offer an incentive to consumers to purchase low alcohol beer instead of beers with a higher alcohol content, and accordingly to encourage the safer use of alcohol products.

I propose to take Questions Nos. 80 to 86, inclusive, together.

As Minister for Finance, it would not be appropriate for me to comment on any individual transactions.

On the more general questions raised by the Deputy, I am advised that NAMA is a designated person pursuant to Section 25(1) of the Criminal Justice (Money Laundering and Terrorist Financing) Act 2010 (the "Act") when it is carrying out the activity of lending. As a designated person, NAMA is required to have procedures for the assessment and management of risks of money laundering or terrorist financing, based on a methodology proportionate in its detail and complexity to the size and nature of the business and the inherent risks of money laundering or terrorist financing. NAMA has such procedures in place.

I am further advised that when undertaking loans sales, which is a distinct activity from that of lending, NAMA conducts Anti-Money Laundering due diligence checks on a best practice basis in order to mitigate reputational risk. In all such transactions, NAMA is particularly interested in establishing the identity of the ultimate beneficial owners. Where such transactions include UK persons/entities, NAMA may make enquiries through the Serious Organised Crime Agency (SOCA), as appropriate.

Where property sales are conducted by debtors, notwithstanding the funds from such a sale may ultimately be used to repay NAMA debt, NAMA is not a party to the property transaction. The relevant Anti-Money Laundering checks are conducted by the parties to the transaction, that is, the solicitors involved in the transaction and the financial institutions through which the funds may flow, as designated persons in their own right.

I am informed that in this case the transaction was notified and cleared by SOCA in the UK as the purchaser was a PEP (politically exposed person).
