Invalidity Pension Applications

Deputy John McGuinness asked the Tánaiste and Minister for Social Protection the status of an application for invalidity pension by a person (details supplied) in County Kilkenny; if the application will be expedited; and if supplementary welfare allowance will be paid, as the family are currently experiencing hardship. Invalidity pension (IP) is a payment for people who are permanently incapable of work because of illness or incapacity and who satisfy the pay related social insurance (PRSI) contribution conditions.

The department received a claim for IP for the person concerned on 20 July 2015. The person concerned was refused IP on the grounds that the medical conditions for the scheme were not satisfied. He was notified on the 21 September 2015 of this decision, the reasons for it and of his right of review and appeal.

Supplementary Welfare Allowance (SWA) provides a basic weekly allowance to eligible people who have little or no income. Applicants must satisfy a number of qualifying conditions including a means test. The person concerned is advised to make an application for SWA through his local Community Welfare service so that his eligibility may be determined.

Disability Allowance Payments

All payments of disability allowance (DA) to the person concerned have issued. There are no outstanding DA payments due to him. His DA payment issues weekly to the post office and no cheques issued to him for any DA entitlement.

The client concerned should provide the Department with an up to date Rent Supplement application form and lease agreement confirming any increase in their monthly rent. On receipt of this documentation, the client's rate of Rent Supplement entitlement can be assessed.

Jobseeker's Allowance Payments

The person concerned was in receipt of a jobseeker's allowance payment from 30/08/2000 until the 26/06/2015. The payment was suspended as the person concerned declared himself unfit for work. He was asked to produce a medical note to this effect but none was supplied.

The person concerned made an application for disability allowance on 6/05/2015 and was refused on medical grounds on 3/07/2015. Further evidence was received for review and he was notified on 25/08/2015 that the review was unsuccessful. The person concerned was advised of his right of appeal but to date no record of an appeal has been received by the Social Welfare Appeals Office.

It is open to the person concerned to reapply for disability allowance or jobseekers allowance. In addition if the person concerned is currently without an income he may also make an application to his local community welfare service.

The Department has not been informed of any change of circumstance for the client concerned. The client is in receipt of her full entitlement to Rent Supplement based on monthly rent, weekly income and family composition. The client should advise the Department of any changes in their circumstances which might alter this entitlement.

Community Employment Schemes Places

The person concerned commenced on a community employment (CE) scheme sponsored by the North Kildare Leisure Club Ltd on 2/11/2009 and is due to finish with this CE scheme on 23/10/2015. The person concerned is eligible to participate for a maximum of six years on CE which they will have completed on the 23/10/2015.

As the person concerned will have utilised their maximum time allowable on CE in October 2015 it is then open to him to contact his local Intreo office in order to seek information regarding the training and employment opportunities that may be available to him.
