230. Deputy Bernard J. Durkan asked the Minister for Justice and Equality the extent to which all of the issues arising from an incident followed by an arrest on 7 April 2012 in the case of a person (details supplied) in County Kildare have been fully investigated; if any outstanding matters remain to be dealt with in the case; and if she will make a statement on the matter. The person to whom the Deputy refers has been in correspondence with my Department in relation to this incident. In that correspondence she referred to the matter having been decided upon by the Court. As the Deputy is aware, the Courts are independent, subject only to the Constitution and the law, in the exercise of their judicial functions. Accordingly the individual concerned was advised that it was not open to me to comment or intervene.

In any other respect, as the Deputy is also aware, the investigation of crime is a matter for the Garda Commissioner, and is not a matter in which I have any role.
