Deputy Seán Kyne asked the Minister for Finance the procedures followed to protect and respect the rights of tenants in properties which have come under the control of the National Asset Management Agency; and if there are procedures to secure the continuation of services, such as refuse collection. View answerNAMA does not own or manage properties and is not, in any instance, a landlord. NAMA has acquired loans. Its role in relation to properties is, like a bank, that of a secured lender. Other than properties that have been enforced, all of which are managed by the appointed receiver/administrator, properties continue to be managed by their original owners.
Therefore, it is NAMA debtors and receivers which are responsible for the efficient management of properties securing NAMA's loans. This includes all engagement with tenants. As a secured lender, NAMA expects its debtors and receivers to comply fully with the relevant contractual and statutory obligations, including all rights and protections afforded to residential tenants.
