322. Deputy Willie Penrose asked the Minister for Justice and Equality the level of progress in terms of legislative proposals to accommodate pre-nuptial agreements to enable them to be enforced by the courts; if any consideration has been given to the report of the study group on pre-nuptial agreements in 2007; and if she will make a statement on the matter. I have met representatives of the IFA and of the ICMSA to ascertain their views on the issue of affording legal recognition to pre-nuptial agreements. As I have previously indicated, this issue is a complex one which could lead to serious implications for both parties to a marriage. In this context, my Department will organise a consultation process in the first half of 2016 to ascertain the views of those potentially affected by such a proposal as part of the process of developing a policy position on this issue.
