927. Deputy Finian McGrath asked the Minister for Transport, Tourism and Sport why he did not release documents under the access to information on the environment regulations to a named person (details supplied) in County Meath. [46793/15]

A request made to my Department by Mr. Cantwell was refused under the European Communities (Access to Information on the Environment) Regulations 2007-2014. In accordance with the thrust of the Regulations, the Department sought to assist and guide Mr. Cantwell in considering a new application.  In this context a visit to the Department's offices was arranged on 10 August 2015 to facilitate Mr. Cantwell to view records retrieved by my Department from the Department of Environment. This was to assist Mr. Cantwell to assess whether he wished to make a new more targeted AIE request for information reflecting records actually held by the Department. In order to further assist Mr. Cantwell my Department compiled a schedule of the documents tagged by Mr. Cantwell during his visit. It was explained to Mr. Cantwell in extensive correspondence, that if he wishes the Department to consider releasing documentation to him under the AIE Regulations that he needs to submit a new application and that application will then be considered in accordance with the terms of the AIE Regulations.
