Agri-Environment Options Scheme Payments

329. Deputy Colm Keaveney asked the Minister for Agriculture, Food and the Marine when a person (details supplied) in County Galway will receive payment under the agri-environment options scheme; and if he will make a statement on the matter. [46613/15]

My Department is currently examining approximately 400 cases that submitted invoices from one particular company to verify and support claims under the non-productive capital investment action of AEOS. It is known that in some cases the invoices submitted were for amounts different to those actually paid by the participants.

Funding provided under the scheme comes partly from the EU and partly from the National Exchequer. There is a requirement and obligation to ensure that the expenditure claimed by scheme participants reflects the reality of what took place. For that reason my Department wrote to participants requesting alternative proof that the amounts claimed were in fact the amounts paid.

The person named above was written to on 11 June 2015, requesting the submission of alternative verifiable proof in respect of one invoice. No reply was received to this letter and despite repeated attempts by my Department officials they have been unable to contact the person concerned on either of the two telephone numbers listed on their AEOS file. If the person-named makes contact with the Department, the matter can be progressed.

The person named submitted applications requesting transfers by both Change of Legal Entity and lease from his own name to a Company. Following the submission of these applications the person named changed his herd number from his name to the Company name. This created a situation whereby the transfer of allocation right was not in line with EU Regulatory requirements pertaining to the Basic Payment Scheme. An official from my Department has been in direct contact with the person named to discuss the options available to him.

The persons named submitted a 2015 Transfer of Entitlements Allocation Right and Reference Value application to my Department to transfer allocation rights and reference values by change of registration details. This application has been fully processed and payment under the Basic Payment Scheme issued on 11 January 2016.

Applications under the ‘young farmer’ category of the National Reserve and the Young Farmers Scheme were also received from the second person named. Work is ongoing in relation to these applications to take account of this change to the herd number with a view to the application being fully processed and payment issuing as soon as possible.

Deputy Ruth Coppinger asked the Minister for Agriculture, Food and the Marine if there is a need to introduce regulations surrounding the conduct of hunts and to licence hunts; if he has received any complaints regarding the conduct of hunts in the years 2011 to 2015; and if he will make a statement on the matter. The regulation of hunting is primarily the responsibility of the Department of Arts, Heritage and The Gaelteacht, through the National Parks & Wildlife Service which issues hunting licences in the case of some species, including deer. Hunting also operates under codes laid down by the Hunting Association of Ireland. These guidelines must be observed at all times.

My Department’s responsibilities in relation to hunting derive from the Animal Health & Welfare Act 2013. Section 12 of the Act provides that the activity is lawful unless the animal is hunted having been released in an injured, mutilated or exhausted condition. The Animal Health & Welfare Act 2013 contains robust measures relating to the ill-treatment of animals and these can apply where hunting is not conducted in accordance with the provisions of the Act. Therefore I do not envisage any further legislation in this area.

A small number of complaints about specific cases have been reported to my Department over the time period referred to by the Deputy, and where appropriate, these have been brought to the attention of An Garda Síochána.

My Department provides funding for the UN World Food Programme (WFP), the Food Aid Convention (FAC) and the Food and Agriculture Organisation (FAO) through annual subscriptions and additional contributions as part of our commitments under Ireland’s Official Development Assistance (ODA). Annual contributions are also paid to a number of external international organisations, and membership/registration fees are paid to professional bodies in line with my Department’s statutory obligations.

The vast bulk of the Department’s advertising consists of press notices in the specialised farming press, provincial and national newspapers. This expenditure includes the publication of Statutory Notices that are required to comply with various national and EU legislative requirements. Other media such as television, radio, specialised agricultural magazines and social media are rarely used. Decisions on the placement of notices are made on a case by case basis, depending on the target audience.

The person named submitted an application under the ‘Old Young Farmer’ category of the 2015 National Reserve to my Department. One of the eligibility criteria for applicants under the National Reserve is that they must have successfully completed a recognised course of education in agriculture giving rise to an award at FETAC Level 6 or its equivalent, or have commenced such a course before 31 December 2015. Based on the evidence of educational qualifications submitted by the person named in support of his application he has not attained the required educational standard.

A letter has issued to the person named informing him of the decision in relation to his application and advising him of his right to appeal that decision.

I propose to take Questions Nos. 340 and 382 together.

Inshore fishermen who may be experiencing financial difficulties while ashore due to the adverse weather should contact the Department of Social Protection which offers income support payments, subject to certain eligibility criteria. The National Inshore Fisheries Forum has invited the Department of Social Protection to its forthcoming meeting on 21 January to discuss social protection policies relevant to the inshore sector. It is important that the fishing industry take every precaution to avoid risk of injury or worse during this period and have full regard to local weather warnings before venturing to sea.

The new Seafood Development Operational Programme under the European Maritime and Fisheries Fund was adopted by the European Commission in December 2015. That Programme provides a comprehensive range of supports for the seafood sector, including a dedicated scheme of supports for the inshore sector to address the various economic and sustainability challenges facing the sector. In relation to specific measures to support inshore fishermen affected by significant losses arising from adverse weather events, the EMFF and the Operational Programme provide for the establishment by fishermen of a Mutual Fund for Adverse Climatic events and Environmental Incidents, which when established can provide aid to fishermen affiliated to the Fund in line with pre-defined rules. The Operational Programme will co-fund the Mutual Fund, together with subscriptions from member fishermen. In that sense, the viability of such a Mutual Fund is dependent on the extent to which fishermen commit to membership of that Fund.

Following the December adoption of the Programme, I am now rolling out new schemes and will be launching the first schemes later this month, with others to follow during 2016. I will be discussing with fishing representatives how they may establish this Mutual Fund over the course of 2016.

The full details of the number of GLAS Tranche 1 applications which qualify for GLAS+ payments, as a result of their applications including two or more priority environmental measures, will only be available when the full year GLAS payment calculations are finalised . The calculation of full year GLAS payment rates per application are under development by my Department but current estimates indicate that some 1,400 Tranche 1 applications will qualify for GLAS + payments.

I am pleased to say that 2015 has proved to be the most successful year ever in the development and implementation of any agri-environment scheme. GLAS Tranche 1 resulted in the approval of in excess of 26,000 applications. In addition in October 2015 I launched a second tranche of GLAS which closed for submission of applications in mid December. This second tranche has resulted in a further 14,000 applications to GLAS and my Department will be assessing these applications in line with the requirements set out in the scheme Terms and Conditions over the coming weeks to ascertain which applications can be approved for GLAS.

This level of applications, which has exceeded expectations, underlines the success of GLAS in supporting Irish farmers’ commitment to further enhancing the environmental sustainability of their farm enterprises.

The level of applications to GLAS under both tranches in 2015 will result in the funding committed to the Scheme for 2016 being fully utilised. The full details of the funding required for GLAS in 2016 will not be fully finalised until the Tranche 2 approval process has been completed at the end of January.

However the value of the average contract submitted under both Tranches is over €4,000, not including GLAS Plus cases. Current indications are that some 1,400 applications from the first tranche will qualify for GLAS Plus, increasing their annual payment to around €6,500 on average.
