Traffic Calming Measures

923. Deputy Tom Fleming asked the Minister for Transport, Tourism and Sport if he will liaise with Transport Infrastructure Ireland to erect speed limits at an early date on the N72 road at approaches to Beaufort Bridge junction, as this area includes a heavy-trafficked junction adjacent to Beaufort village, a busy retail unit and a spur road junction just east of Beaufort Bridge, and given the increased tourist traffic and hazardous traffic conditions that already exist; and if he will make a statement on the matter. Any proposed alteration of the existing speed limit applying to the stretch of road in question is a matter for Kerry County Council in the first instance.

While the Road Traffic Act 2004 sets default speed limits for national roads (both within and outside built up areas), local authorities, in this case Kerry County Council, may, in consultation with the Garda Commissioner and with the consent of Transport Infrastructure Ireland (TII), make bye-laws to set Special Speed Limits for such roads in their administrative areas.

To assist local authorities in the application of Special Speed Limits, I launched my Department's updated Guidelines for Setting and Managing Speed Limits in March last which are available on the Department's website www.dttas.ie. These Guidelines reiterate that the making of Special Speed Limit bye-laws is a matter for the elected members of local authorities, subject to following Department Guidelines and to the consent of TII in the case of national roads. 

At the time of the issuing of these Guidelines, local authorities were requested to review and update all speed limits in their administrative areas in accordance with the Guidelines and this is currently ongoing. In the case of national roads, local authorities were requested to undertake this review in conjunction with TII.

It should be noted that TII has engaged in a process of assessing the widths of all national roads and it will provide this information to local authorities. This will assist local authorities in the task of identifying the appropriate speed limits for different sections of national road (including the section referred to by the Deputy) in accordance with Departmental Guidelines.

A request made to my Department by Mr. Cantwell was refused under the European Communities (Access to Information on the Environment) Regulations 2007-2014. In accordance with the thrust of the Regulations, the Department sought to assist and guide Mr. Cantwell in considering a new application.  In this context a visit to the Department's offices was arranged on 10 August 2015 to facilitate Mr. Cantwell to view records retrieved by my Department from the Department of Environment. This was to assist Mr. Cantwell to assess whether he wished to make a new more targeted AIE request for information reflecting records actually held by the Department. In order to further assist Mr. Cantwell my Department compiled a schedule of the documents tagged by Mr. Cantwell during his visit. It was explained to Mr. Cantwell in extensive correspondence, that if he wishes the Department to consider releasing documentation to him under the AIE Regulations that he needs to submit a new application and that application will then be considered in accordance with the terms of the AIE Regulations.

Cycling Facilities Provision

Deputy John Lyons asked the Minister for Transport, Tourism and Sport if he is aware that the Santry River greenway project has not been included in the National Transport Agency's 2016 works programme; if this project would link residential communities with high unemployment directly with areas of employment where existing transport links are otherwise very poor; if he will engage with the National Transport Agency with a view to including this project in its works programme as it is the only section of the agency's strategic greenway network not yet to come forward for planning, yet it has potential to be one of the most successful; and if he will make a statement on the matter. It is not possible to give a breakdown of capital spend on transport on a county by county basis as requested by the Deputy as some capital spend cannot be allocated to a specific county (e.g. rail safety management systems, signalling and rolling stock, Bus Eireann buses).

Details of the regional and local road grant payments to county councils from 2010-2015 are outlined in the regional and local road grant payment booklets which are available in the Dáil Library. With regard to national roads, details of the actual drawdown of funding for these roads are a matter for Transport Infrastructure Ireland (TII). Overall capital spend on transport by the Exchequer can be found in the annual Estimates publication.

As part of work undertaken to define a 'Strategic Framework for Investment in Land Transport', my Department's Economic and Financial Evaluation Unit undertook research into the level and composition of transport investment historically. As part of this work, the total level of investment in land transport was analysed by the Central Statistics Office. However, total investment in these items, defined as Gross Fixed Capital Formation, is not available on a regional basis. Further details on this analysis are contained in SFILT Background Paper 10 which is entitled 'Historical Trends and International Benchmarking' and is published on the websites of my Department at www.dttas.ie and the Irish Government Economic and Evaluation Service at www.igees.gov.ie.

Given the competing road safety priorities which my Department has had to deal with, my officials could only turn their attention to the RSA's review of the arrangements in relation to the roadworthiness testing of vintage vehicles in the latter part of 2015.

  The RSA's review has now been examined by my officials and recommendations have been submitted to me for my consideration.  I intend to come to a decision on this issue in the coming weeks.

I appreciate the value of the vintage and veteran vehicle movement and have reiterated on a number of occasions that none of the recommendations contained in the RSA's review would involve those who currently enjoy an exemption from compulsory testing, that is, those owners of cars and motor caravans first registered prior to 1 January 1980 and used for social and domestic purposes, being brought within the compulsory roadworthiness testing regime.

My Department provides funding to the National Transport Authority (NTA) for the development of public transport infrastructure in the Greater Dublin Area (GDA) which includes a rolling programme of bus replacement and refurbishment of the Bus Éireann PSO fleet both in the GDA and nationally.

Accessibility is built into all new public transport infrastructure projects and vehicles from the design stage and this has enabled all Bus Éireann's regional cities fleet to be 100% wheelchair accessible. In addition, approximately 65% of the Bus Éireann coach fleet is wheelchair accessible by lift.

My Department also funds an ongoing programme of accessibility improvement grants to upgrade existing public transport infrastructure and facilities.  Most Bus Éireann bus stations have received accessibility upgrades under this Programme and funding has also been allocated for a number of wheelchair accessible bus stops. 

The Accessibility Grants Programme is being managed by the NTA on behalf of my Department.  I understand from the Authority that replacement of non-wheelchair accessible vehicles for Bus Éireann's subsidised services would cost in the region of €90 million.

The improvement and maintenance of regional and local roads in Kerry is the statutory responsibility of Kerry County Council, in accordance with the provisions of Section 13 of the Roads Act 1993. Works on those roads are funded from the Council's own resources supplemented by State road grants.  The initial selection and prioritisation of works to be funded is also a matter for the Council.

I understand that Kerry County Council has examined a number of options concerning road access at Rossbeigh and that officials from my Department have met with an official from Kerry County Council in relation to possible options.  The proposal from the Council is being considered in the context of the overall 2016 budget available to my Department.  I expect to announce the 2016 allocations for regional and local roads shortly.

As Minister for Transport, Tourism and Sport, I have responsibility for overall policy and funding in relation to the national roads programme.  The planning, design and operation of  individual national roads is a matter for Transport Infrastructure Ireland (formerly known as the NRA) under the Roads Acts 1993 to 2015 in conjunction with the local authorities concerned.

Furthermore, the statutory power to levy tolls on national roads, to make toll bye-laws and to enter into toll agreements with private investors in respect of national roads is vested in TII under Part V of the Roads Act 1993 (as amended by the Planning and Development Act 2000 and the Roads Act 2007).

Noting the above position, I have referred the Deputy's question to TII for direct reply.  Please advise my private office if you do not receive a reply within 10 working days.

Swimming Pool Projects

Under the Local Authority Swimming Pool Programme grant aid to a maximum of €3.8 million is provided to local authorities towards the capital costs of new swimming pools or the refurbishment of existing pools. The current round of the Local Authority Swimming Pool Programme was closed to new applicants on 31 July 2000. Since 2000, 58 projects have or are being dealt with under the Local Authority Swimming Pool Programme of which 50 have been completed and the other 8 projects are at various stages of the Programme. I wish to commence the process of opening a new limited round of swimming pool allocations and I have asked my departmental officials to report back to me on this matter.

As the Deputy is aware, I met with Kildare County Council and a number of public representatives, including Deputy Durkan, in mid July. It was agreed that Kildare County Council would write to my Department on the matter but no submission has yet been received.
