Bank Codes of Conduct

Question:

97. Deputy Michael McGrath asked the Minister for Finance the number of customer mobility measures that have been implemented in respect of Irish banks as a result of European Union action; his views on the effectiveness of such measures; and if he will make a statement on the matter. [3710/16]

I presume that the question refers to measures to encourage or assist customers of Irish banks in moving to other banks. The Deputy will be aware that the Central Bank's Code of Conduct on Current Account Switching came into effect on 1 October 2010. This Code is designed to make the process of switching current accounts easier and quicker and to offer protection and support for consumers when switching bank account. The Switching Code places obligations and time limits on both the old and new bank when completing the switching process.  This issue is also addressed in the Payment Accounts Directive which was adopted in 2014. My Department is currently working on its transposition. 

The restructuring plans for Bank of Ireland, AIB and PTSB contained certain provisions in relation to customer mobility and public versions of these are available on the EU website. http://ec.europa.eu/competition/state_aid/register/.  The individual banks' adherence to their commitments are independently assessed by monitoring trustees and reported at least every six months to the Commission.  One element of the State Aid approval process is that the Commission has required AIB and PTSB to fund a public awareness campaign to raise awareness and promote customer switching. My Department is currently in the process of preparing a tender competition to meet this commitment.

The Deputy may also be aware that the EU Commission published a green paper on retail financial services in December which is available at http://eur-lex.europa.eu/legal-content/EN/TXT/?uri=COM:2015:630:FIN. The paper seeks views on how to improve choice, transparency and competition in retail financial services to the benefit of European consumers. The Commission is seeking views from interested parties by 18 March 2016.

As I have previously said, I would strongly encourage prospective borrowers and other consumers of financial services to shop around for the best deal available. In this regard the Competition and Consumer Protection (CCPC) website, www.consumerhelp.ie has very useful information on comparative offerings of financial services. 

Film Industry Tax Reliefs

Deputy Michael McGrath asked the Minister for Finance the number of applications for section 481 relief; the amount of tax relief granted and the number of film projects supported in each of the years 2011 to 2015; if he is satisfied with the operation of the scheme; and if he will make a statement on the matter. I am advised by the Revenue Commissioners that a wide range of statistical information is available on the Commissioners' Statistics webpage at: http://www.revenue.ie/en/about/statistics/index.html.

The Deputy will be aware that the Income Tax scheme for investment in Film was replaced in 2015 by a new scheme of Corporation Tax relief to Film Producer Companies. The new scheme has been in place since January 2015. The operation of the scheme is monitored by my Department and the Revenue Commissioners, and I believe the scheme is working correctly.

The following table sets out the information in relation to the Income Tax film relief scheme which closed for film applications in December 2014. The information for 2014 and 2015[1] is still provisional.

[1] In 2015 65 film projects were certified under the new Corporation Tax relief for film Producer Companies. Of these projects 43 claimed relief during 2015 with an associated cost to the Exchequer of €17.5 million.

Bank Codes of Conduct

99. Deputy Michael McGrath asked the Minister for Finance if he will place a clause in the code of conduct for mortgage lenders to require them to charge a reduced interest rate on the warehoused section of a split loan; and if he will make a statement on the matter. [3712/16]

The Deputy will be aware that the Central Bank's Code of Conduct on Mortgage Arrears (CCMA) is a statutory Code issued under Section 117 of the Central Bank Act 1989 and that it applies to all regulated mortgage lenders and credit servicing firms operating in the State when dealing with borrowers facing or in mortgage arrears on their primary residence. 

The completion of affordability assessments is a key step in the Mortgage Arrears Resolution Process (MARP).  In this regard a lender must examine each case on its individual merits and it must base its assessment on the full circumstances of the borrower, including, inter alia, the overall indebtedness of the borrower.

While the CCMA obliges lenders to explore all of the options for alternative repayment arrangements offered by that lender under step 4 of the MARP, it does not oblige lenders to offer and apply a particular set of options nor does it approve the specific options that a lender does offer. 

The Central Bank, including in its role as part of the Single Supervisory Mechanism (SSM), remains focused on providing a fair and consistent process for the borrower through the CCMA, the Mortgage Arrears & Resolution Targets (MART) audits and against defined Sustainability Guidelines. 

The Deputy will also of course be aware that the Central Bank is an independent organisation in the performance of its supervisory role and it would not be appropriate for me to direct it in how it fulfils its regulatory oversight role in respect of financial institutions. 

Fuel Laundering

I am advised by the Revenue Commissioners that the number of oil laundries detected and closed down in the period from 2011 to 2014 was 31. Details of those detections, by year and by the counties in which they occurred, are set out in the following table.

There were no detections of laundries during 2015.

I am satisfied that significant progress has been made in tackling fuel laundering, and am assured that action against such activities will continue to be a high priority for Revenue.

Blind Welfare Allowance Eligibility

101. Deputy Michael McGrath asked the Minister for Finance if he will extend the €825 per year tax allowance in respect of trained guide dogs for the blind to trained autism-assistance dogs; and if he will make a statement on the matter. [3714/16]

A blind person who maintains a trained guide dog is allowed a sum of €825 per year in computing the gross eligible health expenses.  This is the equivalent of a tax credit of €165 and is only available in respect of fully trained guide dogs.  The qualification criteria for granting this additional relief is that the individual must be entitled to the Blind Person's Tax Credit under section 468 Taxes Consolidation Act 1997 (TCA) and must also provide written confirmation from the Irish Guide Dogs Association that he or she is the registered owner of a trained guide dog.

To qualify for the Blind Person's Tax Credit, an individual or the individual's spouse or civil partner must have impaired vision to an extent specified in the legislation and certified by an eye specialist, i.e. a medical practitioner with an additional qualification in Ophthalmic Medicine or Ophthalmic Surgery, or a registered Optometrist.  A doctor's certificate is not sufficient.

Relief in respect of health expenses is allowed in accordance with the provisions of section 469 of the Taxes Consolidation Act 1997.  In order to qualify for relief an individual must show that he or she has incurred health expenses for the provision of health care.  For the purposes of section 469 "health care" is the prevention, diagnosis, alleviation or treatment of an ailment, injury, infirmity, defect or disability.

Given that there is a requirement for certification by a qualified practitioner in order to obtain the Blind Person's Tax Credit, the use of a fully trained guide dog to alleviate the disability is deemed to constitute a health expense and it is on this basis that this additional relief for health expenses is allowed. Autism assistance dogs are primarily trained to act to improve the behaviour of autistic children by promoting calmness and acting as a safety aid.  These dogs act as a constant companion for the child and in certain circumstances can enhance the child's social skills and interaction with their family and peers.

While the companionship, improved calmness and other such benefits are well testified, it is not clear that a medical basis that would bring such effects under the health legislation exists, and to allow relief for health expenses in this context would inevitably lead to calls for similar treatments, therapies or pet companions in other cases to qualify for relief. 

Insurance Industry

102. Deputy Michael McGrath asked the Minister for Finance the status of Setanta Insurance policyholders with outstanding claims; and if he will make a statement on the matter. [3715/16]

The liquidation of an insurance company is a legally complex process.  Setanta is a Maltese incorporated company and, therefore, the Setanta liquidation is being carried out under Maltese law. 

Progress in the liquidation of Setanta Insurance has been awaiting the outcome of legal proceedings in the case of the Law Society of Ireland versus the Motor Insurers' Bureau of Ireland (MIBI).  On 4th September 2015, the High Court held that the MIBI is liable in respect of claims against the policy holders of Setanta. This decision was appealed by the MIBI and the appeal was heard between the 12th  and 14th of January 2016.  We are currently awaiting the outcome. 

As this case is sub judice, there are certain matters which I am not in a position to comment on at this time.  I am responding to the Deputy's question as best as I can within these constraints. 

The Liquidator for Setanta has informed me that:

- The number of open claims was 1,696 as at 30th November 2015.

- The claims reserves position stands at between €87.7 million and €95.2 million.

- The Liquidator is continuing to accept new claims up until May 2016, two years after the insurance policies issued by Setanta were cancelled.

- Final settlements can only be paid out after all of the company's liabilities are quantified, including claims.

- The Liquidator reports that it is proving difficult to settle claims in advance of the outcome of the MIBI appeal.

I expect to be in a better position to inform the House further after the legal proceedings are concluded.

Pension Provisions

103. Deputy Michael McGrath asked the Minister for Finance if he will review the threshold for so-called trivial pensions; and if he will make a statement on the matter. [3716/16]

I am informed by the Revenue Commissioners that in relation to what are known as "Trivial Pensions" they allow the payment of once off pensions in certain limited circumstances.

If the scheme beneficiary and trustees agree, Revenue will raise no objection to the payment of once off pensions. This may only take place where the total of all funds available for pension benefits, following payment of any lump sum benefit, is less than €20,000 (increased from €15,000 in 2007). The quantum of retirement benefits from all sources must be taken into account for the purposes of calculating the €20,000 limit.

The level at which pensions can be commuted under the "Trivial Pensions" rule is kept under review by Revenue. However, as one of the principal objectives of any pensions policy is to provide a regular income to persons during the course of their retirement it would not be advisable to allow the commutation of large numbers of pensions under the "Trivial Pensions" rule. For this reason, there are no plans at the moment to increase the level from €20,000.

Tax Code

I am advised by the Revenue Commissioners that under the EU VAT Directive (Council Directive 2006/112/EC) and Irish VAT legislation, the full consideration for the supply of all developed residential property is liable to VAT at the rate of 13.5%.  Specifically, Article 73 of the Directive provides that the taxable amount shall include everything which constitutes consideration obtained or to be obtained by the supplier, in return for the supply, from the customer or third party.

Property developers, who are registered for VAT, charge VAT on sales of developed residential property but are entitled to recover the VAT incurred in the development of that property. As such, the final customer who purchases a residential property incurs VAT at 13.5% on the consideration paid. 

I am further informed by the Revenue Commissioners that it is not possible to furnish precise figures of the amount of VAT collected from this activity. This is due to the fact that the information provided to Revenue on VAT returns does not require the yield from specific transactions or activities to be identified. While Revenue on occasion uses detailed Central Statistics Office consumption or expenditure information for VAT estimates, neither is sufficiently detailed for the purpose requested by the Deputy.

My Department's latest forecasts, which underpin Budget 2016, are set out in the Economic and Fiscal Outlook, published as part of the Budget 2016 documentation. They project GDP growth of 6.2 per cent in 2015 and 4.3 per cent in 2016, with an average growth rate of around 3 per cent for subsequent years. 

The text in the Budget documentation explicitly recognises that outside of Ireland's main export markets the pace of economic expansion has slowed and the outlook has become increasingly uncertain. The text also notes that while the spillover effects to Ireland's main trading partners appear to have been limited to date, a more pronounced impact cannot be ruled out.

The Budget documentation also included a comprehensive quantitative risk analysis on the impact on the Irish economy and public finances for a range of economic shocks using outputs from the ESRI HERMES macroeconomic model. One of the shocks estimated the impact of a 1 per cent downturn in global output. The results, published in Table 14 of the Economic and Fiscal Outlook chapter, indicate that a permanent one per cent decrease in global output levels would reduce Irish GDP by one per cent relative to the Department's baseline forecasts, primarily through a reduction in Irish export growth, with an upward impact on the  deficit of one  quarter per cent of GDP. 

The Deputy will already be aware that my Department's forecasts were endorsed by the Irish Fiscal Advisory Council and also, that in its recent Fiscal Assessment Report, the Irish Fiscal Advisory Council welcomed the Department's analysis of risks and noted that it represented an important input into discussions around the macroeconomic and fiscal outlook.

Overall I am confident that these forecasts are realistic, and take due account of risks which are explicitly recognised.
