Deputy Sean Fleming asked the Minister for Agriculture, Food and the Marine the level of link-up between Enterprise Ireland and Bord Bia in relation to clients who could be assisted by both organisations; if he will identify where the lines are drawn between these two organisations in relation to assisting export companies; the arrangements in place to share information in respect of clients to further assist Irish exporters; and if he will make a statement on the matter. The work of both Enterprise Ireland and Bord Bia organisations in relation to agri food is consistent with the over arching Food Wise strategy for the development of the agri food sector. Their Chief Executive Officers are members of the Food Wise High Level Implementation Committee, which is chaired by the Minister for Agriculture, Food and the Marine. Enterprise Ireland is responsible for the development and growth of Irish companies in world markets. It works in partnership with these companies to help them start, grow, innovate, be competitive, including through the provision of grants, and the provision of business and management advice. Bord Bia’s focus is on the development of markets for Irish food and livestock and for promotion of Irish food and drink at home and around the world.

In line with the FoodWise 2025 strategy, Enterprise Ireland is committed to working with food and drink companies to help them scale, be competitive and innovative, and to create sustainable jobs across every region in Ireland. Enterprise Ireland has resources in over 30 international locations, facilitating access to more than 60 countries worldwide.

Bord Bia’s recently published strategy, Making a World of Difference, focuses on market and consumer insight, the development of people, building new routes to market, the Origin Green programme – a world first - and promoting and communicating in the digital age.

Bord Bia operates from overseas offices in Amsterdam, Dubai, Dusseldorf, London, Madrid, Milan, Moscow, New York, Paris, Shanghai and Stockholm, with new offices due to open shortly in Singapore and Warsaw. Most offices are co-located with the Enterprise Ireland and/or Irish embassy network.

Both agencies work together to support Irish food and drinks companies to grow jobs and exports. Irish food and drink exports have now experienced six consecutive years of growth to reach €10.8 billion in 2015, which is 52% higher and €3.7 billion more than in 2009.

Enterprise Ireland and Bord Bia link in multiple ways including the following;

(i) Bord Bia is a member of Enterprise Ireland’s Capital Investment Initiative Committee and R&D Committee.

(ii) Bord Bia assists Enterprise Ireland with commercial due diligence on proposed investment cases.

(iii) The Minister for Agriculture, Food and the Marine has led a number of overseas trade missions involving both agencies, who frequently work together in planning and executing overseas activities and events

(iv) The FoodWorks programme developed by Bord Bia, Enterprise Ireland and Teagasc provides intensive support for food and drink entrepreneurs. The 4th FoodWorks programme was recently launched and is currently sourcing applicants.

Bord Bia supports companies to undertake market research, provides market and consumer insights to the sector and supports food and drink companies to attend trade events. Enterprise Ireland’s overseas offices may assist food and drink clients in regions and in partnership with Bord Bia where Bord Bia does not have an office/resource in place. Client related information is shared provided the client company gives its permission for this.

The application under the National Reserve was received after the scheme closing date and is subject to a small late penalty. Such applications are currently being finalised and payment will issue shortly.

The persons named submitted an application under the ‘young farmer’ category of the 2015 National Reserve with the second person named as the young farmer. This application was not successful as the applicants were deemed to have exceeded the off farm income threshold of €40,000. The applicants were notified of this decision and offered the opportunity to submit an appeal.

My Department has now received an appeal from the persons named in relation to their National Reserve application. This appeal will be considered by my Department based on the information set out by the applicants and a decision with regard to the outcome of the appeal will be notified in writing to the applicants as soon as possible.

Teagasc is one of the main providers of further education in agriculture, food, horticulture, forestry and equine studies. The availability of courses is a matter for Teagasc and not the Department of Agriculture, Food and the Marine.

Teagasc advise that they issued an application form to the person in question for the part-time Green Cert programme on 7th Oct 2015 for a course commencing 6th November 2015. That person subsequently contacted Teagasc’s local office in Killarney in late January 2016 seeking a place on the part-time Green Cert programme. However, a place could not be offered as the course had commenced the previous November.

The applicant is advised to contact their local education officer for further advice on Green Cert participation.

The owners of the above mentioned herd number have applied for the Single/Basic Payment Scheme for all years from 2008 to 2015. On processing of the 2015 Basic Payment Scheme application, it was identified that a forestry parcel was not eligible for payment as it was claimed as scrub in 2008. On further examination, it has been identified that this parcel was incorrectly paid for Single Payment in 2011, 2012 and 2013. A process of recoupment of these overpayments will now be initiated.

The Beef Technology Adoption Programme was a three year programme for 2012, 2013 and 2014. The person named submitted a valid application in 2012 and was subsequently paid in full in December of each of these years. No payment is due for 2015 as the Programme ceased in 2014.

The applicant named received approval on the 17 December 2015 for the installation of a 10 unit Milking Machine, meal troughs and individual cow meal feeders under the Dairy Equipment Scheme of TAMS II. In this case the approval issued covered all of the items applied for and on the basis of this approval the works may proceed. Instructions on how to submit the payment claim will issue shortly.

An Official from my Department has been in direct contact with the person named to clarify issues regarding this application. These issues have been clarified and the application can now be processed to facilitate payment under the Basic Payment Scheme shortly.

The person named also submitted applications under the National Reserve and the Young Farmers Scheme to my Department. Once payment under the Basic Payment Scheme is made these applications can be finalised with a view to payment shortly thereafter.

There are a number of applications, including that of the person named, remaining which have not passed all of the Department’s pre-payment validation checks for the 2015 part-year payment. The Department is continuing to investigate these issues including the correction of any IT or data issues with a view to all these remaining cases meeting the payment validation checks so that they will be paid the full amount of their 2015 part-year payment in May including the 2015 GLAS balancing payment.

The person named did not hold entitlements under the Single Payment Scheme and therefore does not hold an automatic allocation right under the 2015 Basic Payment Scheme.

There is no record of my Department having received an application under the Private Contract Clause, National Reserve or Young Farmers Scheme measures of the Basic Payment Scheme from the person named.

A late application for the Areas of Natural Constraints scheme was received from the person named in October 2015. As this application was outside the application period it could not be accepted. My Department is currently reviewing the circumstances of this application and will be in touch with the person named shortly.

EU Regulations governing the Basic Payment Scheme provide that all farmers who were eligible to receive a direct payment greater than €100 in 2013 (Single Payment, Grassland Sheep Scheme, Burren Life Scheme, Beef Data Scheme) have an automatic allocation right under the Basic Payment Scheme in 2015. The persons named did not receive a direct payment in 2013 and therefore do not hold an allocation right into the Basic Payment Scheme. The persons named purchased entitlements in 2014 and received Single Payment on those entitlements for that year, however, this does not provide them with an allocation right into the new Basic Payment Scheme in 2015. The persons named have also submitted a 2015 Private Contract Clause application to my Department seeking the transfer of land and corresponding entitlements by lease as Transferees. The Transferor in the case has an outstanding 2013 Single Payment that requires to be finalised in order to render them eligible to transfer the land and entitlements for 2015. This 2013 payment will be finalised shortly, following which the Private Contract Clause application can be finalised to facilitate payment to the persons named.

The person named submitted a 2015 Private Contract Clause application to my Department seeking the transfer of land and entitlements by lease as Transferee to the Company name shown. As the person named was not farming in 2013 he did not hold an allocation right into the Basic Payment Scheme. In May 2014 my Department had issued a letter to the Company to advise them to transfer the allocation rights from the person named to the Company name. The documents required to transfer the allocation right into the Company name were not received by my Department until 1 February 2016. The allocation right has now been transferred across to the Company name, the Private Contract Clause application has been fully processed and the outstanding payment under the Basic Payment Scheme will be made shortly.

The person named submitted a Private Contract Clause application as transferor on the 25th May, 2015 to transfer 69.23 Basic Payment scheme entitlements. He also submitted an application to have his Basic Payment Scheme entitlement value reviewed under force majeure circumstances. Both applications have been deemed successful. This resulted in 71.31 Basic Payment Scheme entitlements being established for the person named with a total value (including greening) of €7,704.58.

The Private Contract Clause application has resulted in the transfer of 69.23 entitlements with a total value ( including greening ) of €7,586 to another person while 1.08 entitlements with a total value (including greening) of €118.58 has remained in the account of the person named. Payment will issue to the person named in the coming days.

The person named submitted a 2015 Basic Payment/Areas of Natural Constraint Scheme application on 11 May 2015. EU Regulations governing the administration of these schemes require that full and comprehensive administrative checks, including in some cases Remote Sensing (i.e. satellite) inspections, be completed before any payments issue.

The application of the person named was selected for a Remote Sensing eligibility inspection. This inspection identified minor discrepancies between the area declared and the area determined resulting in an over-declaration in area of less than 3% and under 2ha, which resulted in payments due being calculated on the area determined. The person named was notified of the inspection decision on 29 November 2015 and of their right to seek a review of the decision. To date no appeal has been received.

Following the completion of the processing of an application to transfer entitlements, payments due under 2015 Basic Payment Scheme issued on 15 March 2016 and 29 March 2016 to the nominated bank account of the person named.

The person named commenced their AEOS 2 contract on 1 September 2011 and was paid in full for the 2012 – 2014 Scheme years.

Under the EU Regulations governing this scheme and other area-based payment schemes, a comprehensive administrative check, including cross-checks with the Land Parcel Identification System, must be completed before payment can issue.  The application of the person named was also selected for an on-farm inspection which took place on 9 October 2015.  During this inspection non-compliance with the Terms and Conditions of the Scheme was noted in relation to the Natura, Traditional Hay Meadow and Species Rich Grassland actions which resulted in a penalty being incurred.

The application will now be processed on the basis of the inspection findings and payment in respect of the 2015 Scheme year, less the appropriate penalty, will issue at the earliest opportunity.

Deputy Noel Grealish asked the Minister for Agriculture, Food and the Marine the progress of his investigation into a reported case of suspected neglect involving a number of horses in the Briarhill area of County Galway, a number of which died; the resources allocated to the prevention of cruelty and neglect of animals in each local authority area; the number of prosecutions in each local authority area over each of the past five years, the person they were taken by and their outcome; and if he will make a statement on the matter. My Department has organised the removal of up to 8 horses on welfare grounds from the Briarhill area of Galway city in the past month. A number of horse carcasses were also removed. None of the rescued horses or horse carcasses were microchipped and, while my Department has a policy of prosecuting for suspected cases of animal neglect and cruelty, it is not possible to bring about a successful prosecution in the absence of a microchipped horse/carcass.

My Department does not have information on the questions relating to the resources allocated to the prevention of cruelty and neglect in animals and the number of prosecutions in each local authority area as these are matters to be addressed by the relevant local authorities.

My Department provides substantial financial assistance, amounting to almost €1m in 2015, to local authorities in the context of implementation of the Control of Horses’ Act by these bodies. In addition, my Department awarded grants of €2.54m last December to 140 organisations involved in safeguarding animal welfare throughout the country.

Some €94,000 of these grants were awarded to animal welfare bodies based in Galway, including €40,000 to GSPCA to assist their work this year in protecting animal welfare throughout the county.

Since the extended deadline for receipt of Basic Payment applications was 23 June 2015 this application was deemed to be late with a 100% penalty. This file is currently being reviewed taking account of the appeal lodged and the circumstances outlined and the person named will be contacted regarding the outcome.

The person named was originally penalised on his REPS contract in the amount of €4,927.42, which was a 51% penalty on the full 2013 Scheme Year payment due to him of €9,661.66. This penalty was notified to the person named by Farmers Statement from the Department dated 20 January 2014.

The person named subsequently appealed the penalty imposed to the Agriculture Appeals Office and was partly successful in his appeal, with the total REPS penalties reduced by 30% from 51% to 21% by an Agriculture Appeals Office decision letter dated 12 November 2014. An amount of € 2,898.51 was refunded to the participant on 16 February 2015 in line with the decision of the Agriculture Appeals Office. The REPS contract ended on 31 December 2014 and the final year payment for 2014 issued in two instalments in January and February 2015. There are no outstanding payments due to the participant.

My Department has been investigating a number of cases involving the submission of invoices, which originated from one particular source, to verify and support their claims under the non-productive capital investment action of AEOS. It is known that in many cases the invoices submitted by participants, or their representatives, were for amounts greater than what was actually paid by the participants for the purchase of trees and hedgerow plants. Funding provided under the scheme comes partly from the EU and partly from the National Exchequer. There is a requirement and obligation to ensure that the expenditure claimed by scheme participants reflects the reality of what took place.

The person named was written to by the Department in September 2014 requesting the submission of alternative verifiable proof to support an invoice that was included in the claim for expenditure incurred. A number of letters have been exchanged since, including correspondence with the person’s Solicitor. However, no additional information has been received since the submission of the original payment claim.

A letter was issued to the person named on 25 January 2016 informing them of a determination made by the Department in the case which included the clawback of undue payments already made and the imposition of penalties as set out in the EU Regulations. A final decision letter was issued to the person named on 24 February 2016, again outlining the clawback of undue payments made and the penalties to be imposed. The applicant was afforded the opportunity to appeal this decision to the Agriculture Appeals Office within three months of the date of the review letter.

A further letter issued to the person named on 31 March 2016 giving details of the amount to be recouped. There are no payments due to be made in this case.

286. Deputy Michael Ring asked the Minister for Agriculture, Food and the Marine when a person (details supplied) in County Mayo will receive a third payment under the agri-environment options scheme. [5683/16]

The person named commenced their AEOS contract on 1 May 2013 and was paid in full for the 2013-2014 scheme years.

Under the EU Regulations governing the Scheme and other area-based payment schemes, a comprehensive administrative check, including cross-checks with the Land Parcel Identification System, must be completed before any payment can issue.  The application of the person named was also selected for an on-farm inspection which took place on the 14 September 2015. During this inspection non-compliances with the Terms and Conditions of the Scheme were noted in relation to the Traditional Stone Wall Maintenance and the Species Rich Grassland actions which resulted in a penalty being incurred.  The application will now be processed on the basis of the inspection findings and payment in respect of the 2015 Scheme year, less the appropriate penalty, will issue at the earliest opportunity.

The current contract relating to the provision of a service for the haulage of TB reactor cattle and other animals for disease control purposes runs until June 2017. My Department can extend the contract for a further period or periods of up to one year from that date subject to the other provisions of the contract.

It is therefore not proposed to seek a new tender for this service until 2017 at the earliest.
