199. Deputy Pat Breen asked the Minister for Agriculture, Food and the Marine the status of an application by a person (details supplied) in County Clare under the young farmers capital investment scheme; and if he will make a statement on the matter. [6584/16]

The applicant in this case submitted an application under the first tranche of the TAMS II Young Farmers’ Capital Investment Scheme. The Terms and Conditions of the Scheme require that for an applicant to qualify for the higher grant rate of 60% they must meet the requirements of set-up for the first time within five years of the date of receipt of an application under the scheme. The application was rejected on 22 December 2015 as the applicant was deemed to have been set up in farming for more than five years prior to making an application under the Scheme . The applicant requested a review of the decision and was advised that the original decision was upheld on review by letter dated 8 January 2016. The Agriculture Appeals Office has indicated that an appeal has been received in relation to the case and a decision is awaited from that office.
