159. Deputy Éamon Ó Cuív asked the Minister for Agriculture, Food and the Marine the amount of an overpayment assessed against a person (details supplied); the amount clawed back to date by withholding payments; if there is an appeal on hand against this penalty; if so when he will make a decision in this regard; and if he will make a statement on the matter. An application under the Basic Payment/Areas of Natural Constraint Scheme was received in my Department from the person named on 27 May 2015. Following processing, a commonage evidence issue was disclosed in respect of eight commonage parcels declared. The declaration was in respect of 2 shares of these parcels but only evidence of entitlement to 1 share was provided.

My Department has reviewed the case and decided to process the application without penalty on the eligible hectares declared. The application will be re-calculated on this basis and any payments due will issue directly to the nominated bank account of the person named as soon as possible.
