765. Deputy Catherine Murphy asked the Minister for Health to arrange for a person (details supplied) who has been on a waiting list for surgery for more than 18 months and who was returned to the waiting list having been outsourced to a facility that does not carry out the specific surgery needed to be outsourced to a hospital that does carry out the required operation; the number of similar cases that were referred to the facility and returned to the waiting list; if the waiting list has increased again for that reason; and if he will make a statement on the matter. Under the Health Act 2004, the Health Service Executive (HSE) is required to manage and deliver, or arrange to be delivered on its behalf, health and personal social services. Section 6 of the HSE Governance Act 2013 bars the Minister for Health from directing the HSE to provide a treatment or a personal service to any individual or to confer eligibility on any individual.
