Electronic Cigarettes

Deputy Marcella Corcoran Kennedy asked the Minister for Health the reason the mechanics, cost and detail required by manufacturers of vaping products to comply with the law have not been forthcoming from his Department, regarding the drafting of legislation to implement the EU Tobacco Products Directive (TPDII) and more specifically, Article 20(2) referring to a proposed notification submission system for vaping products; the estimated cost of the notification system to the State per annum; the way that cost has been calculated; the way the scheme will be funded; when the notification scheme will be published; the body that will be responsible for the management of the notification system; the products which will need to be notified and by whom; and if he will make a statement on the matter. The regulation of electronic cigarettes is provided for in Directive 2014/40/EU, and in particular Article 20; Commission Implementing Decision (EU) 2015/2183 establishing a common format for the notification of electronic cigarettes and refill containers and Commission Implementing Decision (EU) 2016/586 on technical standards for the refill mechanism of electronic cigarettes. The Directive is required to be transposed by 20 May 2016, and my Department is currently working with the Office of the Parliamentary Counsel to transpose the requirements of the Directive and the Implementing Decisions.

As my Department will be unable to ascertain the number of manufacturers and importers of electronic cigarettes and refill containers before 20 November 2016, it is not possible to quantify the estimated cost at this stage.

The Department holds no property in its own right. It is currently housed in Hawkins House which forms part of the estate portfolio for the Office of Public Works. Details for other bodies under the aegis of the Department are operational matters for the bodies concerned and the Deputy should contact the relevant Director/CEO/Registrar directly.

A sustainable community rated market requires intergenerational solidarity whereby a constant influx of young healthy members support ageing less healthy members. Building on the recent upturn in the economy two initiatives were introduced from 1 May 2015. Lifetime Community Rating and reduced premiums for Young Adults promote the sustainability of the insurance market as a whole. Without these measures, there would be a continued deterioration in the age profile of the insured population, which in turn would contribute to claims inflation and result in higher insurance premiums. The number of people who currently hold private health insurance is now 2.126 million, or 46% of the Irish population, (end Jan 2016). This includes an increase of 104,667 from January 2015 to January 2016 which contributes positively to controlling premium inflation.

We have a highly competitive insurance market. While I welcome the recent reduction in the number of products from 416 at end 2015 to 354 now, I agree that product proliferation is not in the interest of consumers. I have asked my officials to examine what supports could further reduce products. In the meantime many consumers can make savings on their health insurance premiums by taking advantage of promotional offers and by reviewing their level of cover to ensure that their needs are being met, without being over-insured. The Health Insurance Authority website offers a clear price comparison and can be accessed at www.hia.ie. All of the health insurers provide a number of lower cost plans, making it possible for consumers to find the same level of cover for a cheaper price.

Finally, I would remind the Deputy that Insurance companies operate as commercial providers and make their own commercial decisions including pricing policies. The Minister for Health has no legal power to intervene in relation to any insurer’s prices. You may wish to note however, that in the 12 months to end December 2015, the average gross premium received by insurers was €1,173, which represents a 2% decrease on the average premium received in 2014 (€1,200).

Long-Term Illness Scheme Eligibility

The Long Term Illness (LTI) Scheme was established under Section 59(3) of the Health Act, 1970 (as amended). Regulations were made in 1971, 1973 and 1975 specifying the conditions covered by the LTI Scheme, which are as follows: acute leukaemia; mental handicap; cerebral palsy; mental illness (in a person under 16); cystic fibrosis; multiple sclerosis; diabetes insipidus; muscular dystrophies; diabetes mellitus; Parkinsonism; epilepsy; phenylketonuria; haemophilia; spina bifida; hydrocephalus; and conditions arising from the use of Thalidomide. There are no plans to extend the list of conditions covered by the LTI Scheme. This being the case, the Department of Health has not conducted specific research into the projected cost of adding Crohn's Disease to the LTI Scheme.

Under the Drug Payment Scheme, no individual or family pays more than €144 per calendar month towards the cost of approved prescribed medicines. The scheme significantly reduces the cost burden for families and individuals incurring ongoing expenditure on medicines.

Under the provisions of the Health Acts, medical cards are provided to persons who are, in the opinion of the HSE, unable without undue hardship to arrange GP services for themselves and their dependants. In the assessment process, the HSE can take into account medical costs incurred by an individual or a family.

The National Waiting List Management Policy, A standardised approach to managing scheduled care treatment for in-patient, day case and planned procedures, January 2014, has been developed to ensure that all administrative, managerial and clinical staff follow an agreed national minimum standard for the management and administration of waiting lists for scheduled care. This policy, which has been adopted by the Health Service Executive, sets out the processes that hospitals are to implement to manage waiting lists.
