826. Deputy Jim O'Callaghan asked the Minister for Agriculture, Food and the Marine if Riversdale Avenue, Dublin 6, is an urban area for the purposes of section 19 of the Forestry Act 2014; and, if under this Act, a person would need a felling licence in this area. [13633/16]

The Forestry Act 2014 has not yet been commenced and therefore the provisions of the Forestry Act 1946 still apply. Under section 37(4) (d) of the 1946 Act a person does not require a felling licence to fell trees which are standing within one hundred feet of any building other than a wall or temporary structure.
