495. Deputy Margaret Murphy O'Mahony asked the Minister for Agriculture, Food and the Marine if aquaculturalists who are outside the remit of Natura 2000 areas and are fully compliant and awaiting his determination on a renewal licence may receive interim licences in circumstances where resources are not in place to provide licences within a timely manner; and if he will make a statement on the matter. Applications for aquaculture licences are considered by my Department in accordance with the 1997 Fisheries (Amendment) Act, the 1933 Foreshore Act and applicable EU legislation.

The legislation does not provide for the issue of interim licences.

In the case of operators who are currently in the process of renewing their licences, pending a decision on the renewal, operators may lawfully continue their aquaculture activity under the provisions of Section 19A(4) of the 1997 Fisheries (Amendment) Act.
