268. Deputy Michael Healy-Rae asked the Minister for Agriculture, Food and the Marine his views on correspondence (details supplied) regarding planning permission; and if he will make a statement on the matter. [17736/16]

Sheep fencing investments in TAMS II in general does not require planning permission. However, if the proposed sheep fencing (whether new or replacement) is in a Special Area of Conservation, a National Heritage Area, a Special Protection Area or a Natura 2000 habitat, any upland or seaside area that has not been previously fenced or enclosed, then planning permission or a declaration of exemption from the relevant local authority is required at time of application for sheep fencing measures under TAMS II.
