691. Deputy Brendan Griffin asked the Minister for Agriculture, Food and the Marine when he will make a decision on an appeal by a person (details supplied) in County Kerry under the agri-environment options 2 scheme; and if he will make a statement on the matter. [21066/16]

The person named commenced their AEOS 2 contract on 1 September 2011 and was paid for the 2011-2015 Scheme years.

Under the EU Regulations governing the Scheme and other area-based payment schemes, a comprehensive administrative check, including cross-checks with the Land Parcel Identification System, must be completed before any Scheme year payment can issue. The application of the person named was selected for an on-farm inspection which took place on 8 November 2013. During this inspection non-compliances with the Terms and Conditions of the Scheme were noted in relation to the Riparian Margins and the Coppicing Hedgerows actions which resulted in a penalty being incurred and a monetary amount was deducted from the 2013 Scheme year payment. The person named was given the option to request a review of the decision to apply a penalty by the Regional Inspector. There is no record of a review request being received in this case.
