210. Deputy John McGuinness asked the Minister for Health if he will arrange an early date for an operation for a person (details supplied) which has been deemed urgent by their general practitioner and consultant; the reason this operation was not carried out in December 2014 as promised, when the urgency of the case was highlighted on an ongoing basis by their general practitioner; if he will insist on an early date, as the stress and anxiety of the wait is causing further distress and worry to the person; and if he will make a statement on the matter. Under the Health Act 2004, the Health Service Executive (HSE) is required to manage and deliver, or arrange to be delivered on its behalf, health and personal social services. Section 6 of the HSE Governance Act 2013 bars the Minister for Health from directing the HSE to provide a treatment or a personal service to any individual or to confer eligibility on any individual.
