Deputy John McGuinness asked the Minister for Health the services and supports that have been put in place for persons who suffer side effects after having their tonsils removed; the number of such cases reported relative to County Cork hospitals and Waterford Regional Hospital; the number of such operations carried out in each of the hospitals; the criteria used by the HSE to select patients and refer them to each hospital; the cost of such operations in each of the hospitals; the way in which complaints of side effects from such operations are dealt with and prioritised; and if he will make a statement on the matter. The HSE makes in-patient services available to specific categories of persons under Section 52 of the Health Act 1970, as amended. In accordance with Section 53 of the Act, the charge in respect of in-patient services is set out in the Health (In-Patient Charges) Regulations 1987 (S.I. No. 116/1987). Regulation 4(1) provides the list of persons exempted from any charge made in respect of in-patient services provided under Section 52 of the Health Act, including those who hold a medical card.

As the HSE is responsible under law to levy appropriate in-patient charges where applicable, you'll appreciate that it is contrary to the HSE Governance Act of 2013 for me to make a direction to the HSE or a hospital regarding this issue.

On 14 July 2016, the HSE confirmed that, as part of a contingency plan drawn up by the Department of Health, the HSE, Pieta House and David Hall, who had been acting as interim CEO of Console, Pieta House will commence providing the services previously provided by Console with immediate effect. These services comprise the 24/7 Suicide Helpline, the Suicide Bereavement Liaison Service and the Suicide Bereavement Counselling Service.

Under the Health Act 2004, the Health Service Executive (HSE) is required to manage and deliver, or arrange to be delivered on its behalf, health and personal social services. Section 6 of the HSE Governance Act 2013 bars the Minister for Health from directing the HSE to provide a treatment or a personal service to any individual or to confer eligibility on any individual.

The National Waiting List Management Policy, A standardised approach to managing scheduled care treatment for in-patient, day case and planned procedures, January 2014, has been developed to ensure that all administrative, managerial and clinical staff follow an agreed national minimum standard for the management and administration of waiting lists for scheduled care. This policy, which has been adopted by the HSE, sets out the processes that hospitals are to implement to manage waiting lists.
