Question:

40. Deputy Barry Cowen asked the Minister for Housing, Planning, Community and Local Government if, in the proposals being developed by his Department for mixed development on State-owned lands as part of Pillar 2 of the action plan on housing, there are mechanisms to be put in place which will ensure that the funds received from the disposal of former social housing estates for new mixed developments, which include 50% private housing, will be reinvested by local authorities in social housing elsewhere. As the Deputy will be aware, a very challenging housing crisis exists in Ireland, the root cause of which is an undersupply of housing across all tenures. At an overall level, while 25,000 new homes a year are needed to meet demand, output fell to as low as 8,300 in recent years. At its heart, the Government's Rebuilding Ireland Action Plan on Housing and Homelessness is about increasing and accelerating housing delivery, across all tenures, to help individuals and families find homes. The active pursuit of housing provision on State lands, including local authority lands, is an important part of delivering on this overall ambition.

This involves the State extracting the maximum value for its lands in the shortest possible timeframe. In practical terms this should include accelerating social housing delivery, securing more homes at lower price points and providing homes to rent at affordable prices. Local authorities are pivotal in managing the overall planning and development of such mixed tenure housing developments, and will likely involve tailored solutions for each individual case.

Opportunities for private and social housing development on publicly-owned land banks can be advanced under a variety of arrangements. The development of these proposals, including the delivery and financing models used, will be influenced by experience gained from such models as Dublin City Council’s Housing Land Initiative proposals for mixed-tenure developments.

In addition, Rebuilding Ireland contains a number of integrated actions to underpin land supply management, including the development of a national Land Supply Management Strategy, within the context of the new National Planning Framework. This will involve identifying and mapping sites in local authority and public ownership with appropriate lands to be master-planned to deliver increased mixed-tenure housing, including social and more affordable housing.

Local Authority Housing

41. Deputy Thomas Pringle asked the Minister for Housing, Planning, Community and Local Government the consultation which took place with the banks when drafting the incremental purchase scheme for tenant purchases of local authority housing to ensure banks would grant mortgages where a local authority charge is based on an authority; and if he will make a statement on the matter. The new Tenant (Incremental) Purchase Scheme came into operation on 1 January 2016. The Scheme is open to eligible tenants, including joint tenants, of local authority houses that are available for sale under the Scheme and applies to all existing local authority houses, other than those classes of houses excluded under legislation. To be eligible, tenants must meet certain criteria, including having been in receipt of social housing support for a minimum period of one year and having a minimum reckonable income of €15,000 per annum.

The terms of the Scheme involve discounts of 40%, 50% or 60% off the purchase price of the house, linked to tenant income. On the sale of a house under the Scheme, the housing authority will place an incremental purchase charge on the house equivalent to the discount granted to the tenant. Generally, the charge withers away over a period of 20, 25 or 30 years depending on the level of discount involved.

The incremental purchase charge is the first charge placed on the house, and would normally have priority over any subsequent charge on the property, including any private mortgage charge. However, the Housing (Miscellaneous Provisions) Act 2014 provides that a housing authority may enter into an agreement with a licensed financial institution, giving the incremental purchase charge a lower priority relative to the private mortgage charge.

The Department met with the Banking & Payments Federation Ireland during the course of the development of the new scheme and will continue to liaise with them as issues arise.

Social and Affordable Housing Provision

42. Deputy Richard Boyd Barrett asked the Minister for Housing, Planning, Community and Local Government the options available to local authorities when negotiating with private developers on the social housing Part V component of private developments; the way in which local authorities may be able to increase the social housing component beyond 10%; the way in which a reasonable profit for the developer will be established; the cost of the Part V component agreed; and if he will make a statement on the matter. Under the amendments to Part V of the Planning and Development Act 2000 made by the Urban Regeneration and Housing Act 2015, the options for a Part V agreement, with effect from 1 September 2015, are as follows:

1 Transfer to the ownership of the planning authority of a part or parts of the land subject to the planning application (section 96(3) paragraph (a));

2 Build and transfer to the ownership of the planning authority, or persons nominated by the authority, of a number of housing units on the site subject to the planning application (section 96(3) paragraph (b)(i));

3 Transfer to the ownership of the planning authority, or persons nominated by the authority, of housing units on any other land in the functional area of the planning authority (section 96(3) paragraph (b)(iv));

4 Grant a lease of housing units to the planning authority, or persons nominated by the authority, either on the site subject to the application or in any other area within the functional area of the planning authority (section 96(3) paragraph (b)(iva));

5 A combination of the transfer of the ownership of land under paragraph (a) of section 96(3) and one or more of the options set out at 2-4 above, and

6 A combination of the options set out at 2-4 above.

Where the developer chooses option 1, this option must be accepted by the planning authority. The price to be paid for the land is its existing use value on the date planning permission for the development was granted.

Where any other option is pursued, the net monetary value to be achieved by a local authority must be equivalent to the difference between the market value and the existing use value (on the date planning permission was granted) of the land that would have been transferred if the agreement had provided for the transfer of land.

The construction costs to be paid to the developer in respect of units acquired are set out in section 96(3)(d)(ii), i.e.

"the costs, including normal construction and development costs and profit on those costs, calculated at open market rates that would have been incurred by the planning authority had it retained an independent builder to undertake the works, including the appropriate share of any common development works, as agreed between the authority and the developer."

It should be noted there is no specific provision made for developer’s profit as such. The section refers to the cost that would have been incurred by the local authority had it retained an independent builder to undertake the works i.e., builder’s profit. This should be a reasonable profit, determined by reference to prices for work pertaining to competitive tenders for similar work current in the locality. Housing Circular 28/2015 issued by my Department to each local authority on 17 July 2015 sets out unit cost ceilings to assist local authorities in this regard.

As regards increasing the social housing component beyond 10%, local authorities and Approved Housing Bodies can and do negotiate with developers – with funding support from my Department - where they wish to pursue options for additional housing units in a new development over and above the units being made available via the Part V obligation. In such cases, it will always be a matter in the first instance for a local authority to assess such options on the basis of a number of criteria including suitability for social housing, tenure mix considerations and value for money.

I also refer the Deputy to the reply to Question No. 146 of 28 September 2016 regarding guidance issued by my Department to local authorities on the provisions of Part V.

Local Authority Housing

Deputy Maurice Quinlivan asked the Minister for Housing, Planning, Community and Local Government his plans, if any, to apply robust social clauses to the local infrastructure fund to prioritise local workers and workers here for employment on any associated schemes; and if he will make a statement on the matter. I recently announced the Government’s approval to the establishment of a Local Infrastructure Fund of €200 million to relieve critical infrastructural blockages to enable the accelerated delivery of housing on key development sites and to improve the economic viability of new housing projects in Dublin and in urban areas of high demand for housing.

The Fund will be composed of an Exchequer allocation of €150 million, matched by a €50 million contribution from participating local authorities. Funding is to be allocated to local authorities on the basis of a competitive bid process in relation to proposals with the capacity to secure the early delivery of additional housing at scale, including at affordable prices.

In line with the Government’s Action Plan for Housing and Homelessness – Rebuilding Ireland, I issued a call for proposals under the new Local Infrastructure Housing Activation Fund to local authorities on 26 August 2016, with a closing date for receipt of proposals of 14 October 2016. It is a matter for local authorities to determine their bid proposals to identify the priority development sites proposed to be activated for housing in the immediate and short term through the removal of infrastructural blockages. Local authorities have also been requested to endeavour to maximise the opportunities for local employment from within existing communities, where feasible, in the locality of any successful funding proposal.

Further arrangements on the implementation of the Fund, in particular arrangements for evaluation and assessment of bid proposals, are currently being finalised by my Department, and I intend to announce successful bid proposals before the end of the year.

Deputy Dessie Ellis asked the Minister for Housing, Planning, Community and Local Government if he will provide a detailed breakdown of the 11,000 acquired units in Pillar 2 of the rebuilding Ireland action plan for housing and homelessness, detailing the types of acquisitions involved. It is estimated that approximately 11,000 new social housing units, of the 47,000 to be delivered under Rebuilding Ireland: Action Plan for Housing and Homelessness, will be acquired by local authorities and Approved Housing Bodies (AHBs) directly from the market or the Housing Agency. Final delivery on this and other elements of the delivery of the 47,000 units will ultimately depend on many factors, including activity in the private sector, capacity of local authorities and AHBs and readiness of projects. However, the estimation is that approximately 2,300 units will be acquired by local authorities and 8,700 by AHBs.

Those to be acquired by local authorities will include second-hand units and turnkeys, while of those to be acquired by AHBs, the majority will be funded using the increased financial allocation available for the Capital Advance Leasing Facility (CALF). This provides an upfront repayable loan of up to 30% of the relevant capital cost of acquisitions, where the units are made available under long-term availability arrangements funded by the Social Housing Current Expenditure Programme (SHCEP). This upfront capital and long-term support allows the AHBs to raise private finance for the balance of the cost, including from the Housing Finance Agency, therefore harnessing off-balance sheet mechanisms.

It is estimated that 1,600 units to be acquired by AHBs will come via a dedicated €70 million fund operating through the Housing Agency, which will facilitate the direct purchase of properties in trust from banks and investors for social housing use. These units will be offered for sale to AHBs, allowing them to access the funding support available under the CALF and the SHCEP, to match loan finance. A further 600 units approximately of those to be purchased by AHBs are likely to be financed under the Capital Assistance Scheme.

In publishing Rebuilding Ireland Action Plan for Housing and Homelessness, the Government has set out a practical and readily implementable set of actions to create a functioning and sustainable housing system. The Plan is available at the website www.rebuildingireland.ie.

The Plan is divided into five pillars, with each targeting a specific area of the housing system for attention.

Pillar 4 of the Plan commits to bringing forward legislation to amend the Residential Tenancies Acts for early enactment. These legislative proposals will be given effect through the Housing (Miscellaneous Provisions) Bill 2016, the General Scheme of which was approved by Government on 27 September 2016. The Bill includes measures to prevent a future recurrence of situations where large numbers of residents in a single development are simultaneously served with termination notices, together with other early actions to enhance the Residential Tenancies Board’s (RTB) enforcement and dispute resolution powers.

In addition, Pillar 4 commits to developing and publishing a comprehensive strategy for the rental sector by the end of this year. The strategy will be structured around 4 key areas: security, standards, supply and services. The overarching objective of the strategy will be to increase supply and support the development of a stable, strong and viable rental sector offering choice for households, investment opportunities for providers and reflecting the rights and responsibilities of both tenants and landlords.

Following completion of the strategy, consideration will be given to the introduction of any further legislative amendments necessary to give effect to the actions proposed.

Under section 159 of the Local Government Act 2001, each Chief Executive is responsible for the staffing and organisational arrangements necessary for carrying out the functions of the local authorities for which he or she is responsible. In this regard, following the sanction for staff by my Department, their recruitment and assignment is a matter for each individual Chief Executive.

Salary scales are set in accordance with central pay policy covering all Public Servants. The placing of an individual employee on the salary scale is a matter for the Chief Executive, based on the experience of the individual, but must be line with Government Pay Policy.
