Deputy Anne Rabbitte asked the Minister for Public Expenditure and Reform the cost of creating a new entrance to the archaeology museum from the office of the Leader of Seanad Éireann while works are being carried out on Seanad Éireann; and if he will make a statement on the matter. To date, no monies have been expended on the temporary link between Leinster House and the National Museum of Ireland. The estimated cost of providing this link forms part of the overall cost of the required works to temporarily accommodate the Seanad Éireann chamber within the Museum. The total estimated cost of the works is €1.7M.

110. Deputy Róisín Shortall asked the Minister for Public Expenditure and Reform if he will provide details of the operation of the PCW 1% allowance within the Civil Service; the purpose of this allowance; the basis on which it is awarded; and the person or persons with responsibility to award this allowance. The framework in respect of the PCW 1% allowance was developed by my Department, in consultation with the relevant union interests, under the local bargaining arrangements in the Programme for Competitiveness and Work 1994 to 1996 (PCW). The purpose of this arrangement was to achieve greater organisational productivity and providing civil service management with flexibility in addressing and enhancing efficiency and effectiveness in Departments and Offices. PCW higher pay scales which incorporate the allowance in question are approved by local departmental senior management for individual recipients subject to specific criteria being met on the part of the individual recipients including satisfactory performance of duties, achievement of objectives, contribution to the Department or Office, experience and suitability.

Deputy Róisín Shortall asked the Minister for Public Expenditure and Reform in respect of the Civil Service grievance procedure Circular 11/2001, if he will clarify if there is any requirement that a staff member must be a member of a trade union in order to pursue such a procedure; the options open to a complainant where the employer does not comply with Circular 11/2001; and the person or body which ultimately is charged with adjudicating on the matter. The Grievance Procedure is a process that seeks to deal with the complaints of individual staff members. Any member of staff can take a grievance under the Procedure and it is not necessary to be a member of a trade union. The procedures for dealing with grievances provide for:

- Informal resolution between the complainant and the person against whom the complaint is being made

- where the issue has not been resolved informally the individual can make a written complaint to the officer concerned

- where a complainant is not satisfied with the response, the matter can be referred to the Personnel Office/HR Manager

- the Personnel Officer/HR Manager shall arrange for a meeting of the parties and shall make a decision on the matter

Where a complainant is dissatisfied with the outcome of the process, he/she may request that the matter is referred to the Mediation Officer. The Mediation Officer is an external and independent adjudicator under the Grievance Procedure. 

Any complaints relating to an immediate and direct loss of earnings as a consequence of the action complained of will be granted access to the Mediation Officer. However, it has been agreed that the following complaints shall not be referred to the Mediation Officer:

- complaints relating to disciplinary action

- selection for promotion

- selection for assignment to a post carrying an allowance or a post abroad

- exclusion from competitions or from consideration for promotion on grounds of health or sick leave record.

The Department of Social Protection delivers Intreo services from a number of premises leased by the Commissioners of Public Works. Summary details of the leases are set out in the Table below.

In locations where the Department does not occupy 100% of the space leased by the Commissioners, the rental figure has been reduced pro-rata to reflect the rent attributable to the Intreo Centre. Certain aspects of leases are commercially sensitive, but if the Deputy has specific queries regarding any of the properties listed, the Commissioners would be happy to provide further information.
